.. when those groups applied for tax – exempt status , their information goes into a ” file . ” All of it . It is for official use only . Only for the judgement of whether the group deserves their non – profit tax status , or not . Just that . Nothing else .

.. it is abundantly clear that those files were used for non – official purposes [felony] . Most likely , several people connived together to put this act to together [conspiracy] . Other people have used IRS and other government assets to keep others from finding out official information [obstruction of justice , lying to congress , lying to federal agents , misconduct in office] ..

.. it matters whether it extends into the ObamaCrap White House . The damage from the above is bad enough . Were staffers or higher ups screwing around with this information [felony – IRS file] . This is serious …

.. we should expect more from the Infernal Revenue Service . It should be non – professional , and most certainly , non – political . People ‘ s most highly personal and financial information is on those tax returns . They deserve a fair judgement from professionals acting in a professional manner . They do not deserve people playing around with that stuff .

.. these groups have had their civil rights violated . Very much so . If things break the way that I believe , Chuck Grassely will be the new chairman of the Finance Committee in the Senate next year , once the GOP gets the majority . God in Heaven help the Service if they have been screwing around , and Grassely has caught them in the act . Chuck will dig and  dig to find out the truth . He will have the aid of Dave Camp (House Ways & Means Chairman) to aid in the digging .

They were having a protest march , entitled ” Moral Monday , ” this week in Raleigh against the new majority of the GOP in the state . To me , it sounds like these guys were behaving like a bunch of crybabies …

.. their furher , Reverend William Barber , has been in the news of late for shooting off his mouth at black Republicans in general , and US Senator Tim Scott [R-SC] , in particular . Barber has called Scott a “ventriliquist ‘ s dummy ” for standing up for what he believes in in the conservative and Tea Party agenda . No , the national N.A.A.L.C.P. is not slapping Barber down for his antics , either …

.. when people abuse the organs of government for their own ends , and they tamper with the rights and freedoms of others .

.. Government prosecutors do have the right to set priorities to maximize the use of scarce resources . What they do not have the right to do is the refusal to enforce the body of law as a whole . Especially when and where prosecution for misconduct is called for .

.. These groups formed and applied for tax – exempt status . They thus created a IRS tax file . These files are not to be misused or abused , especially for misuse for political purposes . I am a C.P.A. , albeit on the bench . I have practiced before the service , and misuse of these files is a felony .

.. It is clear that these files have been misused . Investigation is called for , and the appointment of a Special Prosecutor or an Independent Counsel is called for ..

On Thursday, a town hall meeting hosted by Al Sharpton and the National Action Network to address gun violence exploded into a revolt against “Chicago Machine” politics, Mayor Rahm Emanuel, and the aldermen in City Hall, with panel and audience members calling to vote out their elected officials.

One 82-year-old preacher even called for “Tea Party” style meetings in some of Chicago’s south side communities such as Altgeld Gardens and Trumbull Park.

While the stated goal for Sharpton was to bring the many different groups together to discuss solutions to the city’s violence epidemic, he may not have gotten the types of responses he was looking for. Calls for more gun control laws and getting guns off the streets were nonexistent and not mentioned by residents throughout the session.

Instead, attendees offered solutions addressing the problems facing their community as a whole rather than just taking on “gun violence” itself. Audience members addressed the need for jobs and solving the foreclosure crisis plaguing Chicago’s south and west sides. Perhaps the loudest message—and one that Reverend Al or the Chicago media have yet to report on—echoed by several different people in attendance as well as panel members was that it is time for the black community to start voting differently.

.. Alan Grayson is an over – the – top political figure , that is without question . But what he has done this time has put him waaaay past waaaay over the line .

.. There are quite a few demagogues in the Democratic party . Usually , these find a line that it is not acceptible to cross . Unfortunately , Alan Grayson is not one of them . When he sees any type of that line he either ignores it , or erases it . And as lunatic left fringe as the party leadership is (safe Steny Hoyer of Maryland) , I would think that they would find this commentary” far less than helpful ” . ..  One thing is fundraising . A lightning rod such as Grayson is a perfect foil to lash the DemoCraps with to the mizzen mast . Even more than that , it also represents the future lunacy that is in story (politics and policy both) if the Dems continue in any kind of power , anywhere , ever again . .. Another thing is candidate recruitment . You do not want nuts . But you do want the serious , and the committed . These days ,  the wealthiest the potential candidate , the better …

… the Kentuckian will be the Adults in the Room [Both of Them] …

.. I am referring to , of course , are U.S. Senators Mitch McConnell and Rand Paul , from Kentucky . It will not just be one of them . It will be both of them , working together .

.. Paul is a leader of the Tea Party wing of the GOP . McConnell is , of course , the Minority Leader of the United States Senate . If

McConnell ever again wants to be the Majority Leader , it is in his interest to work with Paul and get the support of the mass of the conservatives in a budget negotiation . Paul is a natural bridge to the House conservatives , many of whom , like him , owe their support , and possibly their elections , to the support of the Tea Party . McConnell knows both Biden and Obama . Once negotiations are able to begin , it is likely to happen through Biden and McConnell . But passage is another thing entirely .

.. Rand Paul may well want to be President of the United States . He has a very effective base of support within the GOP , but he knows that to have an effective chance at winning the election , he needs the support , or , at least , the acquiecence of the Republican estabilishment . The Establishment may not be wild about Rand Paul , but they are not stupid . The Establishment may not be able to stop Paul (who is an ppthamologist) from becoming the nominee , but they might be able to from becoming POTUS , especially if they stay home .

.. the Republican Establishment is moderate turf . They carry critical party support (also $$) in the suburbs and other GOP – leaning areas . The GOP has the South , Texas , and the Great Plains locked up . Oregon is in play . So are many other states , such as Michigan , Pennsylvania , Wisconsin , and Ohio . To carry those , Paul will need the help of the Establishment to win a General Election . Making a critical budget deal , and , nominally , helping the GOP work to win the political battle with an unpopular POTUS will not be easy . The chits that he can earn , as well as the gravitas he will gain from the effort , will be of enormous help .

.. Rand Paul is a choir boy . Literally . It is very highly unlikely that there are “skeletons” in his closet . So , he has a leg up on many of his potential rivals . He does not carry his father ‘  s  space cadet reputation and the accompanying political baggage . If he proves to be an effective candidate , and can , with his father ‘ s (dr Ron Paul’s) help , carry along his father ‘ s base of support , he can win the GOP nomination , and , after that , the Presidential election .

.. First things first . the GOP cannot realistically eliminate ObamaCrapCare . Not now . The way things are starting out , O.C.C. is off to a horrible start . It may well collapse of its own weight . Delaying the individual mandate is probably the best that be achieved , right now . If the GOP makes significant gains , and regains the Senate majority , there will be hell to pay for the left . POTUS will be effectively neuteured . But , first things first . winning the political battle …

… Obama is Going to Reach a Point on ObamaCrapCare …

.. the way that things are going , the idiots in the ObamaCrap Administration are going to reach a point of No Return : they are going to be forced to admit that what they have created will not work .

.. The unions are complaining like hell . The AFL – CIO is realizing that the blowback on the insurance plans is going to hit their members , more than anyone else . Also , the “Cadillac Tax” on the higher – end plans is chiefly going to hit them . The influence that these loons have with the ObamaCraps have is considerable . Whether it will convince the ObamaCrap Administration to go back to the start things all over again is something else .

.. The ObamaCraps do not want to reopen ObamaCrapCare . First , it would be an enormous defeat , one of unimaginable magnitude . They do not control the House , the GOP does , and the concession on OCC would have conservatives in general , and the Tea Party , in particular , licking their chops . Secondly , it would likely lead to the loss of the Senate in 2014 . Many Senators up in that fall ‘ s elections have yes votes on OCC on their records . They also reside in “Red States,” ones in which either John McCain or Mitt Romney (or both) carried their states . The lack of a filibuster – proof majority in the Senate means that the Senate GOP is in the ballgame . A good number of them are likely in position to get even for being “run over” by the DemoCraps during the original OCC debate . Others are new or newer , such as Mike Lee (Ut) , Tim Scott (SC) , and Ted Cruz(Tx) , who are either Tea Party supported , or are Tea Partiers themselves .

.. The GOP would demand a high price for any renegotiation . One point is that the use of H.S.A.s would have to be greatly liberalized . H.S.A.s would put consumers back in the ballgame in terms of economics , and their participation would be anthema to the ObamaCraps . Another point would be medical malpractice tort – reform . The strength of the plaintiff ‘ s bar prevented any action to go after any semblance of tort reform in the original debate . Obama would act as a brake , but the GOP would act to force the plaintiff ‘ s bar to come to the table . There are other items , but these would be the best places to start .

.. The market in health insurance has to be able to work . OCC almost totally prevents it from working . The idiots in Congress have a habit of forgeting that when they pass legislation that there are unintended consequences of the changes that their legislation will make in the law . Some can be foreseen , will the resort to simple logic and foresight . Others cannot , and have to dealt with as best is possible .

targeting the Tea Party – related groups . Whoops !

.. What I wonder is what in the hell is going on in the United States Department of Injustice . Those idiots at Main InJustice should have appointed a special counsel to prosecute this case , long since before now .

.. With this case , there are different parts of accountability . One is political . It means having the ObamaCraps and their flunkies being held to account for their political actions . It is abundantly clear that the ObamaCraps have their fingerprints all over this . It stinks to high heaven . The only point political that remains to me is that whether the accountability for this extends back into the ObamaCrap White House . Possible , yes , but it remains to be seen .

.. The other point of accountability is legal . People need to be held to account for their actions . If their actions were of a civil manner , then they need to be nailed in court . Sovereign immunity normally applies , but violating one ‘ s civil rights is one of the big exceptions . If people have committed criminal acts , then they need to be held to account for their acts . They need to be held to account by a special counsel . Political pressure can be applied , so that if a U.S. Attorney picks up the ball , they can be protected . Also , no ObamaCrap flunkies dare not need apply . None of them would have credibility at all . Period .

Congress’s investigation into the IRS targeting of conservatives has been continuing out of the Syria headlines, and it’s turning up news. Emails unearthed by the House Ways and Means Committee between former Director of Exempt Organizations Lois Lerner and her staff raise doubts about IRS claims that the targeting wasn’t politically motivated and that low-level employees in Cincinnati masterminded the operation.

In a February 2011 email, Ms. Lerner advised her staff—including then Exempt Organizations Technical Manager Michael Seto and then Rulings and Agreements director Holly Paz—that a Tea Party matter is “very dangerous,” and is something “Counsel and [Lerner adviser] Judy Kindell need to be in on.” Ms. Lerner adds, “Cincy should probably NOT have these cases.”

That’s a different tune than the IRS sang in May when former IRS Commissioner Steven Miller said the agency’s overzealous enforcement was the work of two “rogue” employees in Cincinnati. When the story broke, Ms. Lerner suggested that her office had been unaware of the pattern of targeting until she read about it in the newspaper. “So it was pretty much we started seeing information in the press that raised questions for us, and we went back and took a look,” she said in May.

Earlier this summer, IRS lawyer Carter Hull, who oversaw the review of many Tea Party cases and questionnaires, testified that his oversight began in April 2010. Tea party cases under review are “being supervised by Chip Hull at each step,” Ms. Paz wrote to Ms. Lerner in a February 2011 email. “He reviews info from TPs, correspondence to TPs etc. No decisions are going out of Cincy until we go all the way through the process with the c3 and c4 cases here.” TP stands for Tea Party, and she means 501(c)(3) and 501(c)(4) nonprofit groups.

The emails also put the targeting in the context of the media and Congressional drumbeat over the impact of conservative campaign spending on the 2012 elections. On July 10, 2012 then Lerner-adviser Sharon Light emailed Ms. Lerner a National Public Radio story on how outside money was making it hard for Democrats to hold their Senate majority.

The Democratic Senatorial Campaign Committee had complained to the Federal Election Commission that conservative groups like Crossroads GPS and Americans for Prosperity should be treated as political committees, rather than 501(c)(4)s, which are tax-exempt social welfare groups that do not have to disclose their donors.

“Perhaps the FEC will save the day,” Ms. Lerner wrote back later that morning.

That response suggests Ms. Lerner’s political leanings, and it also raises questions about Ms. Lerner’s intentions in a separate email exchange she had when an FEC investigator inquired about the status of the conservative group the American Future Fund. The FEC and IRS don’t have the authority to share that information under section 6103 of the Internal Revenue Code. But the bigger question is why did they want to? After the FEC inquiry, the American Future Fund also got a questionnaire from the IRS.

Ms. Lerner famously invoked her right against self-incrimination rather than testify under oath to Congress. The House Oversight and Government Reform Committee reported this summer that its investigation had found Ms. Lerner had sent official IRS documents to her personal email account, and many questions remain unanswered. Democrats want to pretend the IRS scandal is over, but Ms. Lerner’s role deserves much more exposure.

… as relates to last night …

As the United States approaches the 50th anniversary of the March on  Washington, many are taking the time to reflect on how far the nation has come.  In his Talking Points Memo tonight, Bill O’Reilly speculated what Dr. Martin  Luther King, Jr. would think of the racial situation in America today.

“If Dr. King were alive today, I believe he would be brokenhearted about what  has happened to the traditional family, and not only among blacks.”

O’Reilly speculated that Dr. King would not be pleased with the  out-of-wedlock birth rate, the broken education system and the rap industry. “Would he approve the Civil  Rights Movement that continues to blame American society for the problems  encountered by blacks rather than encouraging personal responsibility as a way  to achieve individual success?”

The  Factor host criticized Saturday’s march in Washington D.C. for being “heavy  on grievance” and “light on problem solving.”

A: I don’t know how to answer that question.  I mean, from an agent standpoint, we didn’t do anything wrong.  We followed directions based on other people telling us what to do.

A: If direction had come down from Washington, yes.

Q: When was this, what time frame? A: I don’t recall the time frame, maybe May of 2010.

Q: But just to be clear, she told you the specific names of these applicants.

A: Yes.

Q: And she told you that Washington, D.C. had requested these two specific applications be sent to D.C.

A: Yes, or parts of them.

Q: Okay.  So she asked you to send particular parts of these applications.

Q: And that was unusual.  Did you say that ?

Q: And she indicated that Washington had requested these specific parts of these specific applications; is that right ?

.. The Congresscritters on the hill have ways to prove this . However , they need to keep their eyes on the ball . Especially before they decide to make any public comments . Someone was digging for deep ideological and and membership information on these groups that opposed the ObamaCraps ‘ agenda . “Rogue agents” who are career government workers are not going to come up with questions like that on their own , but someone who bounced back and forth between the Obama campaign and his White House might.

.. The claim that “rogue agents” came up with the Be On the Lookout (BOLO) list never made any sense. The claim that “rogue agents” came up with the many detailed questions that conservative groups were subjected to never made any sense. The claim that “rogue agents” would come up with so much extra work for themselves, outside their normal responsibilities and outside their union contract, never made any sense. Getting unionized workers to do extra work requires the union’s buy-in. Getting bureaucrats to do extra work requires orders from their superiors. That’s how government works.

… An I.R.S. Agent does not take a “Dump” without Guidance and Orders from On High …

.. An I.R.S. agent that is properly doing their job is enforcing our tax laws . They are doing so in an impartial and non – partisan matter . They execute plans that are set from much higher up , to carry out examinations and audits . They do not even , when needed , take a “Dump” without Guidance from higher ups . If you are not sure , a dump means check your “Six” when you go to the can .

.. I have represented people before the service . These people are thoroughly professional . They do not like to mess around . They generally do not like to waste time . If they are “messing around,” it usually means they have orders from much higher to do it . Generally , they do not do so .

.. I did not represent groups seeking 501c status . Remember , with this stuff , with so – called “social welfare” groups , political activities are permitted . It is blatant out – and – out electioneering (campaign activities) that are out-of-bounds. When a judgement is made , the judgement is supposed to made in favour of the 1st Amendment , and what they can do , instead of what they cannot .

.. When you seek this non – profit status , you should expect to answer questions . Also , expect to have to spend some money on accounting fees and legal fees , so that you do the job right . There are folks out there who specialize in this stuff . I did not . They can and will help you . No , they will not seek to run up their bills . Their job is to help you , not abuse you .

.. Sometimes , those questions are intrusive . I know , I saw them . What the Infernal Service has been doing with this stuff is far below the belt . It is beyond the pale of what should be asked . Ask the experts . The Government should bring its checkbook to settlement negotiations . And with it , a very generous balance .

.. These folks have had their civil rights violated . God willing , these people will be able to get and received justice . The Sekulows (father and Son) at the American Center for Law and Justice (the A.C.L.J.) are some of the very best in the business . The Landmark Legal Foundation is also another one . Keep it up , and keep going .
