.. in the military services , there are offenses that in a civilian would be moral offenses . In the military [under the U.C.M.J. , or Uniform Code of Military Justice] these offenses would be considered crimes , punishable by many different types of punishment , including dismissal from the service , as well as confinement [jail] , and others ….
.. in this case , the one that Dr. Krauthammer is worried about would be considered ” Unlawful Command Influence . ” If it is a civilian that does it , then the military judge has to consider whether the rights of the accused have been violated . If it is someone in uniform , especially an officer , then , it is a crime , and the same judgement would have to be made .
..Even if Bergdahl is guilty as sin , if his rights are violated by anyone , then he could well be set free as a result . What might have been done would have been considered to be prosecutorial misconduct . Then , double jeopardy atttaches , Bye – bye case ..

Attkisson, who has been with CBS News for two decades, had grown frustrated with what she saw as the network’s liberal bias, an outsized influence by the network’s corporate partners and a lack of dedication to investigative reporting, several sources said. She increasingly felt like her work was no longer supported and that it was a struggle to get her reporting on air.
At the same time, Attkisson’s own reporting on the Obama administration, which some staffers characterized as agenda-driven, had led network executives to doubt the impartiality of her reporting. She is currently at work on a book — tentatively titled “Stonewalled: One Reporter’s Fight for Truth in Obama’s Washington” — which addresses the challenges of reporting critically on the Obama administration.
Feeling increasingly stymied and marginalized at the network, Attkisson began talking to CBS News President David Rhodes as early as last April about getting out of her contract. Those negotiations intensified in recent weeks, and her request was finally honored on Monday.
Reached by phone, Attkisson described her resignation as “amicable.” She said she will now turn her attention to the book, which is being published by HarperCollins, a division of NewsCorp (and not by Simon & Schuster, a division of CBS Corporation.) She declined to comment further.
Sonya McNair, the senior vice president for communications for CBS News, said in a statement: “CBS News veteran Sharyl Attkisson is leaving the news division to pursue other endeavors. We appreciate her many contributions and we wish her well.”

.. Louisiana is an unusual byrd . It has what is known in the elections trade as a ” jungle ” primary . Democraps , Republicans , and Independents , everybody runs in the primary , which is held on the regular Election Day [in November] . If the first place winner gets 50% + 1 vote , then they are elected . If not , then the top 2 finishers , regardless of party , go on to the runoff election (usually held about 5 to 6 weeks later) .
.. this year , Landrieux should make the runoff , but it is not guaranteed . If she is the only Dem , then she will make it . If another Dem with any support runs , then she is in deep doo – doo . She and a republican will move on to the (December) runoff election . Depending on the General Eleection results , control of the Senate could be in the balance .

Carson said the audits, which began a few months after his remarks at the National Prayer Breakfast, marked the first time he had been audited in his life.
He also said a charitable organization that aids inmates’ children was informed last year, for the first time in recent years, that they would no longer be receiving a $1 million annual grant from the Justice Department.
“This is solely because you were involved?” Bachman asked.
“Correct,” Carson replied, adding: “…They’ve come after my children in terms of their employment and things like this.”

.. originally , I could have supported something like this . Standardizing the education standards between the states does make some bit of sense . But , not at the loss of state sovereignty and latitute in education policy and planning . Localities need to still have control .
.. Now , I am foursquare against it . The ObamaCraps and their minions have misused it to grab power and funding from the states . They are attempting to jam their ideas of pc history , new english , new math , and other types of pc ideas and subjects , such as pc civics and government . How screwed up is that .
.. States co – ordinating things with localities is one thing . As long as those localities know something of what they are doing , they should be able to retain full control . However , those local folks should be and must be held accountable . That accountability should be academic in nature , through testing and proficiencies , as well as financial , in terms of financial management . But , otherwise , they should be able to do what they want , within the bounds of state guidelines …

(CNSNews.com) – The Internal Revenue Service warned employers in a new regulatory proposal not to come up with clever schemes to avoid Obamacare’s employer health insurance mandate. The IRS said it would soon issue “anti-abuse rules” to discourage employers from taking advantage of any regulatory loopholes. “The Treasury Department and the IRS are aware of various structures being considered under which employers might use temporary staffing agencies (or other staffing agencies)… to evade application of section 4980H [the employer insurance mandate],” the IRS said in a proposed regulatory announcement issued December 28.
The IRS said it would issue a so-called “anti-abuse rule” in an attempt to prevent employers from using temp agencies to circumvent the mandate, essentially writing into law that even though an employer hires temporary workers and therefore is not technically under the mandate’s jurisdiction, the IRS would fine them anyway for not providing health insurance. “It is anticipated that the final regulations will contain an anti-abuse rule,” the agency said. “Under that anticipated rule, if an individual performs services as an employee of an employer, and also performs the same or similar services for that employer in the individual’s purported employment at a temporary staffing agency or other staffing agency of which the employer is a client, then all the hours of service are attributed to the employer for purposes of applying section 4980H.”
In other words, if an employer hires someone part-time, then uses an employment agency to bring the same person on for a second part-time shift, the IRS will still hold the employer liable under the ObamaCare mandate. Similarly, IRS said that if an employer hires the same person for two part-time stints by using two different employment agencies, it will hold either the employer or one of the employment agencies liable for the mandate’s penalties. The issue stems from the employer health insurance mandate in Obamacare, which requires employers with 50 or more full-time employees to provide government-approved, affordable health insurance to at least 95 percent of their employees (and dependents). If any of those employees receives government health insurance subsidies, the IRS will fine the employer up to $2,000 per employee, according to a formula outlined by the IRS.
The warning is part of proposed regulations from the IRS outlining how employers must determine whether they meet the 50 full-time-employee threshold and whether the insurance they offer meets government standards. The IRS said that a full-time employee is one who works an average of 30 hours per week or 130 hours per month, roughly 6 hours of paid service per weekday. The IRS also said that in order for an employer’s health insurance plan to pass muster with the government, it must be available to 95 percent of employees and cost no more than 9.5 percent of an employee’s wages. The agency specified that employers could still fall under the mandate if they employ enough part-time workers to equal 50 full-time workers. For example, if an employer has 40 full-time workers and 20 part-time workers, that employer would be considered by the government to have 50 full-time workers and would be subject to the mandate because the 20 part-time workers average to 10 full-time workers – meeting the 50 full-time-worker threshold.

‘We look like fools:’ A history of Cover Oregon’s failure
PORTLAND, Ore. – In a brief interview with KATU in early January, Gov. John Kitzhaber made an incredible claim about the failed launch of Cover Oregon’s website.
“In late October was when I first learned about the problems,” Kitzhaber said.
The claim was incredible because the website had already missed its Oct. 1 launch date. Kitzhaber was, in effect, saying he didn’t know there were problems until weeks after one of the most important projects under his watch had already failed.
It was incredible because mountains of reports from the state’s quality-assurance contractor had been raising glaring red flags for almost two years.
It was incredible because the state had implemented a stringent set of checks and balances for the specific purpose of making sure the project didn’t spiral without people in power knowing.
And it was incredible because the KATU Investigators have unearthed emails and conducted interviews laying out repeated attempts by lawmakers and others involved with the project to get Kitzhaber’s help in righting what was clearly a sinking ship.
KATU’s review of thousands of pages of emails and reports, as well as interviews with many of the key people involved, suggest that either Kitzhaber knew more than he has acknowledged, or that he and his staff somehow remained oblivious to the unfolding disaster despite numerous attempts to bring it to their attention.
“The governor’s office was not doing anything,” said state Rep. Dennis Richardson, R-Central Point. “He’s got advisors in his office who are over health policy. None of them were doing any oversight that we can see.”
‘They promised … the governor’s office would be very involved’
Let’s start with a quick history lesson.
Cover Oregon began life as perhaps the most ambitious state health exchange in the nation. Its website would include not just access to health-insurance plans, but to all state entitlements: things like food stamps, WIC and Medicaid would all be available through one portal.
The strategy was called “No Wrong Door.”
The federal government liked the idea so much it, offered the state a $48 million “early innovator” grant to fund the project. That amount later ballooned to $59 million.
Not everybody was sold though. With an already tight deadline for building a complicated website, some thought the proposal crossed the line from ambitious to foolhardy.
Richardson, who has announced he will run against Kitzhaber in the fall, was one of those early skeptics. As co-chair of the powerful House Ways & Means Committee in February 2011, he at first blocked the federal grant. He relented only when an agreement was reached to ensure regular independent quality-assurance reports from a company called Maximus and strict oversight of the project.
Richardson sat down for an exclusive interview with KATU in which he revealed new information about Kitzhaber’s oversight of Cover Oregon.
“They were just diving in,” Richardson told KATU. “It was like trying to paint a car that’s already moving instead of making sure that everything’s done before you start moving ahead.”

From the outset, project oversight was designed to be headed by the governor’s office.
The KATU Investigators obtained an organizational chart illustrating the oversight structure. At the top is the governor’s office, to which several different groups report.
There’s the Department of Administrative Services, a government watchdog group that makes sure rules are followed and budgets met.
There’s the Cover Oregon board of directors, the members of which Kitzhaber appointed.
And there’s a joint oversight committee made up of Cover Oregon managers and the Oregon Health Authority – which was led by Bruce Goldberg, the man who has since became director of Cover Oregon.

The state government in Salem had managed to piss away around a quarter of a billion [yes , $250 million] dollars in taxpayer funds on the entire enterprise . The federal website [healthcare.gov] is bad enough , folks . This state – level one is even worse than that , if it is possible .
.. Yes , it is possible . Governor John Kitzhaber (himself a doctor) has led the effort to piss all of that money down the rat hole . Now , Kitz & Company (along with Jeff Merkely , the state ‘ s junior US Senator) are up for election this fall . The fallout from this is going to be devastating . And it keeps getting worse ….
.. somehow , these jokers managed to piss away another [yes , ANOTHER] $100 million in fed funds on the enterprise . Remember , CoverOregon is a state -level exchange . The state of Oregon is responsible for it all . And , you will love this next fact …

According to the C.B.O. , these policy changes are causing up to (or will cause) 2.5 million jobs to be eliminated over the next ten years [at a minimum] . That is at a minimum , to be honest .
.. Given the forecast methods and models of the C.B.O. , I am betting that these numbers have been drastically underestimated . The C.B.O. uses Static Revenue Analysis in its modeling . Any competent economist in a case like this would use Dynamic Revenue Analysis . When they do , the impact is likely to rise by quite a bit …

.. Oregon is , of course , light Blue . Both U.S. Senators are DemoCraps , 4 of the 5 Congresscritters are Dems , John Kitzhaber [himself a Dr] is a DemGovernor , and the legislature is controlled by the Dems . Things are far from hopeless for the GOP , however .
.. John Kitzhaber (the Dem Gov) is on the ballot and is running for re – election . He faces very fierce opposition , becuase four years ago , he was elected with barely 50% of the vote against a little known GOPer [retired NBA star Chris Dudley] . Not sure if Duds is back , but the Cover Oregon debacle has Kitz on the hot seat , with the heat turned up to White Hot . Which is as hot as it gets . My guess is that this colossal mess will make Kitz a sure loser in November …
.. Kitz going down will drag other Dems with him . Not the congressccritters , though . Only 2 of the other 4 House Dem races are competitive . The Oregon legistlature is another matter . So is Jeff Merkely . Ron Wyden is a wily leg vet , but he is thankful that he is not on the ballot . However , Merkely is , and he is a freshman up for his first re – election . Without His Lordship [POTUS] protecting his back , I believe Merkely will come into big trouble come summertime , espc as it becomes known that Kitz is going down . Then , the legislature ..
.. The legislature is competitive , much more so than most people realize . The numbers are : State House , 26 R , 34 D ; State Senate , 14 R , 16 D . So , one chamber , the other , or both could flip with a big enough wave . The possibility is that the Oregon Senate will flip . The Oregon House is another matter . His Lordship is not on the ballot , and Kitzhaber is , which will make for a very interesting couple of days after election day .

Aetna CEO: We might have to pull out of ObamaCare because it’s not attracting uninsured
One of the nation’s biggest health insurers is worried enough about a scenario in which it would have to pull out of Obamacare exchanges that its CEO is willing to talk about the possibility on national TV from Davos. It may be partly a signal to the administration to get this train moving, but it’s no doubt also a reckoning with reality. Obamacare is not attracting the uninsured, and if the administration would stop changing the rules long enough for insurers to get a handle on who is in the exchange population, they’d no doubt find that population is far more sick and expensive than it was supposed to be.
Aetna CEO Mark Bertolini told CNBC on Wednesday that Obamacare has failed to attract the uninsured, and he offered a scenario in which the insurance company could be forced to pull out of program.
The company will be submitting Obamacare rates for 2015 on May 15.
“Are they going to be double-digit [increases] or are we going to get beat up because they’re double-digit or are we just going to have to pull out of the program?” Bertolini asked in a “Squawk Box” interview from the World Economic Forum in Davos, Switzerland. “Those questions can’t be answered until we see the population we have today. And we really don’t have a good view on that.”
He said that so far, Obamacare has just shifted people who were insured in the individual market to the public exchanges where they could get a better deal on a subsidy for coverage. “We see only 11 percent of the population is actually people that were firmly uninsured that are now insured. So [it] didn’t really eat into the uninsured population.”
For Obamacare to work better, it needs more flexibility and choice of insurance programs, Bertolini said. “We need to make it a lot more simpler for people. There needs to be more choice. When you get more choice, you make it more of a market and you get more people in the program.”
Bertolini’s comments illustrate the bind the insurance industry is in—and, yes, they jumped in with Obama on this deal expecting a bunch of people to be forced to buy their product. Obamacare has failed in such a way as to force them to raise rates dramatically. If they raise rates dramatically, the very administration that needs them to stick with the program will be calling them bad apple patent medicine salesmen because vilifying them will be the only hope for politically extricating itself from its policy failure, at least temporarily. And, in the meantime, the industry can’t even get a handle on who is in the exchanges because the administration keeps changing the rules every five minutes. A couple of industry folks told me last week, even if the news about the make-up of the exchanges is bad, it’d be better to figure it out, get some experience with the population, and gauge what can be done for cost containment. Obama’s short-sighted game of switcheroo doesn’t allow much actuarial science to take place.

.. the implementation of ObamaCrapCare has been a colossal failure . Even with the repairs of the website , it is not complete . The middle section [the 834 reports on enrollment] is still throwing off periodic errors , giving the insurers little confidence in enrollment numbers and reports from the government . They have had to take action themselves to reconcile things in order to get an accurate idea of who is enrolled , and who is not .
.. What is worse is the back end . It is still being built . Crist , you would figure that it would have been designed and put together before launch . Not so . Since CGI has been canned by the ObamaCraps , and Accenture has been brought in , hopefully there will be prompt and swift progress in the work . CGI was waaaay over its head . Accenture is a class outfit , top – of – the – mark in the consulting business . They should have been brought in in the first place , damn dummies !
.. it does , however , take time to do the work . Since it will take months to fix the whole operation , and finish the back end , Moody ‘ s has put the entire health care sector under negative outlook financially . to be honest , they deserve it …
