.. congressional oversight is an important part of Congress ‘ job . Besides the making of law and the changing of law , understanding and investigating what is going on in the government at large is damned important . However , Congress is only one part of a 3 – part system of government …

.. Congress relies on the separation of powers . Congress can issue a subpoena , but it relies on the other two branches to enforce a subpoena . The judicial branch will clearly enforce one , but what about when the executive branch is clearly failing to do its job ….

….Right now , I believe the Executive branch is failing in its duty . They should be acting to enforce a Congressional subpoena . However , right now , they are not doing so . They are actively working to obstruct the work of Congress by failing to do so . Worse is the conduct detailed here …

DOJ Working With Elijah Cummings To Protect The IRS

An aide to the attorney general accidentally calls the office of the House Oversight Committee chairman, asking for help in spinning the defense of the agency whose head just said they obey the law when they can.

We have commented many times of the all-too-cozy relationship between the IRS and Democratic members of the House and Senate, with members writing to the agency demanding that specific conservative groups and political action committees they find particularly irritating be subject to the “special scrutiny” that the Tea Party and other conservative and religious groups were subjected to in the ongoing scandal.

Of particular interest to us has been Rep. Elijah Cummings, D-Md., ranking member on Rep. Darrell Issa’s House Government Reform and Oversight Committee, who has made every effort to keep the committee from finding out the true extent of IRS corruption and abuse of power in its targeting of conservatives…

Now we have Brian Fallon, a former aide to New York Democratic Sen. Chuck Schumer and a communications aide to Attorney General Eric Holder, who mistakenly called Issa’s office thinking it was the office of Cummings and asked for help in leaking documents to selected reporters for the purpose of creating media spin before Issa and his committee could make them public.

As Jonathan Strong reports at Breitbart News, now the subject of an IRS audit, a letter sent by Issa to Holder about the call “describes Fallon as ‘audibly shaken’ when he realizes his request to leak documents to help get ahead of news stories about them was mistakenly made to the very office he was seeking to undermine.”

.. The Executive is actually acting in concert with the House minority to obstruct the investigative acts of the House majority . They are leaking news stories through to the House DemoCraps , who then leak them to so – called ” friendly ” members of the LameStream media . They do it to try to get ahead of a news story in order to manage a news cycle …

.. it is , to say the least , not what they should be doing . They should be co – operating with the House and the Senate , fairly and equally , no matter who runs the place . Conspiring with one side against the other helps to damage our system of government and helps to endanger our rights …

Also , like most any other content provider , it would do something for the nation , in terms of national security , if the situation is important enough . But , why at that point ??

The subject line of the e-mail, which was sent at 9:11 p.m. Eastern Time on the night of the attack, is “Update on Response to actions – Libya.” The was written hours before the attack was over…

“White House is reaching out to U-Tube [sic] to advice ramification of the posting of the Pastor Jon video,” the e-mail reads, according to Issa.

Asked about the document, a senior White House official told ABC News it demonstrates that the White House genuinely believed the video sparked the attack all along, a belief that turned out to be incorrect…

Issa has an entirely different view. He contends the document contradicts the White House assertion that it was the CIA who first pinned blame for the attack on protests in response to the anti-Islamic video.

The “Pastor Jon video” is, I believe, a garbled reference to Pastor Terry Jones, who was publicizing the Mohammed movie to coincide with the anniversary of 9/11. But anyway: Does the e-mail prove the White House’s good faith by showing that the YouTube video was on their radar from the beginning and not something they cooked up to make Susan Rice’s spin that Sunday a bit easier? Or does it prove that the YouTube video did indeed come from a political outfit like the White House, not intelligence agents? Actually, you don’t need the new e-mail to ask that question. At 10:08 p.m. on the night of the attack, less than an hour after the e-mail was sent, the State Department issued this statement from Hillary Clinton:

I condemn in the strongest terms the attack on our mission in Benghazi today. As we work to secure our personnel and facilities, we have confirmed that one of our State Department officers was killed. We are heartbroken by this terrible loss. Our thoughts and prayers are with his family and those who have suffered in this attack.

This evening, I called Libyan President Magariaf to coordinate additional support to protect Americans in Libya. President Magariaf expressed his condemnation and condolences and pledged his government’s full cooperation.

Some have sought to justify this vicious behavior as a response to inflammatory material posted on the Internet. The United States deplores any intentional effort to denigrate the religious beliefs of others. Our commitment to religious tolerance goes back to the very beginning of our nation. But let me be clear: There is never any justification for violent acts of this kind.

There’s no question that the video was on the White House’s radar from the beginning. The questions are (a) who put it there, the CIA or some political actor, and more importantly, (b) why was it still there three days later after information had begun flowing in that a jihadi group was behind the whole thing? The “spontaneous protest” theory was more durable than it should have been, it seems, to the point where it took weeks for Obama to start calling the attack an, er, attack. Figuring out why it was durable is one of Gowdy’s core tasks, along with that pesky government-suppressing-speech thing.

When the clear evidence requires that a government official has a clear ministerial duty to do something that the evidence dictates (and refuses to do so) , then a citizen can act and request a mandamus order from a federal judge .

(George , again) lays out the basics of the criminal case . The law calls for a special counsel to be appointed in such a case , and Holder has refused to do so . Well , the evidence says yes , and his conduct at the Department of Injustice is criminal …

.. when those groups applied for tax – exempt status , their information goes into a ” file . ” All of it . It is for official use only . Only for the judgement of whether the group deserves their non – profit tax status , or not . Just that . Nothing else .

.. it is abundantly clear that those files were used for non – official purposes [felony] . Most likely , several people connived together to put this act to together [conspiracy] . Other people have used IRS and other government assets to keep others from finding out official information [obstruction of justice , lying to congress , lying to federal agents , misconduct in office] ..

.. it matters whether it extends into the ObamaCrap White House . The damage from the above is bad enough . Were staffers or higher ups screwing around with this information [felony – IRS file] . This is serious …

… Why Does Lois Lerner stay Silent ?? …

So, Lois Lerner still won’t talk about her role in the illegal targeting and harassment by the IRS of conservative and Tea Party groups seeking 501(c)(4) tax exemptions. Lerner appeared for a second time Wednesday before the House Committee on Oversight and Government Reform and claimed her Fifth Amendment right not to incriminate herself. It isn’t hard to figure out why Lerner’s lips are sealed.

First, she knows the House of Representatives can cite her for contempt of Congress, but Attorney General Eric Holder would decide whether she is prosecuted on that charge. Lerner need not worry since President Obama has already told the world there wasn’t “a smidgen of corruption” in the IRS actions, and Holder allowed a major Obama campaign contributor to have a role in Department of Justice‘s faux investigation of the scandal.

The second and far more revealing reason Lerner is being what the Mafia calls “a good soldier” is seen in the questions posed to her by Rep. Darrell Issa, the California Republican who chairs the oversight panel. For example, Issa noted that Lerner told a Duke University group in October 2010 that “everyone is up in arms” over the Supreme Court‘s Citizens United decision and that “the Federal Election Commission can’t do anything about it. They want the IRS to fix the problem.” Lerner refused to answer Issa’s request that she explain who was the “they” to which she referred or how they made clear their desire that the IRS “fix the problem.”

Similarly, Issa asked about her statement in a September 2010 email to subordinates in which she directed them to begin “a c4 project” and warned them that “we need to be cautious so it isn’t a per se political project.” Lerner refused to explain why she was worried that the project could be viewed as political. Then Issa asked her about a February 2011 email in which she said “Tea Party Matter very dangerous.” Lerner refused to say either what the Tea Party “matter” was or why she viewed it as “dangerous.”

Finally, Issa told Lerner that another IRS executive had told the oversight panel that she had ordered that Tea Party applications be subjected to a “multi-level review.” She refused to explain why she singled out Tea Party applications for such reviews.

These simple questions – each based on indisputable facts – establish that somebody outside of the IRS told her they wanted the tax agency to “fix” something involving groups seeking 501(c)(4) tax status, that she directed subordinates to begin a (c)(4) project she feared could be seen as “political,” that she viewed Tea Party groups as “dangerous,” and that she ordered that such groups be subjected to “multi-level review.”

Those are the four essential points of the IRS scandal : … Who ordered the tax agency to get involved, who in the tax agency responded, who they targeted and what actions they took. She cannot answer these questions because, as she herself has claimed, that would be incriminating. Lerner and others must hope Issa doesn’t already have the answers.

… Who is Sicker ? …

.. or , better (or worse) yet , an Australian broadcaster , who did a feature on the two in 2010 . She received awards for her work . But did not get any awards for never getting to the truth about the child . Now , we know what happened .

Standing before an American court convicted of the most heinous of child sex  crimes, the double lives of Australian citizen Mark J. Newton and his long-term  boyfriend Peter Truong were laid bare.

‘‘Being a father was an honour and a privilege that amounted to the best six  years of my life,’’ the American-born Newton, 42, told the court.

Moments later Newton was sentenced to 40 years in prison for sexually abusing  the boy he and Truong, 36 from Queensland, had ‘‘adopted’’ after paying a  Russian woman $8000 to be their surrogate in 2005.

Police believe the pair had adopted the boy ‘‘for the sole purpose of  exploitation’’. The abuse began just days after his birth and over six years the  couple travelled the world, offering him up for sex with at least eight men,  recording the abuse and uploading the footage to an international syndicate  known as the Boy Lovers Network.

‘‘Personally .. I think this is probably the worst [paedophile] rings … if  not the worst ring I’ve ever heard of,’’ investigator Brian Bone of the US  Postal Inspection Service told reporters outside the US federal court room in  Indiana.

US District Judge Sarah Evans Barker said the pair deserved a harsher  punishment but were tried at district court level to avoid subjecting a jury to  the repulsive images that had been produced.

‘‘What can be said? What can be done to erase some of the horror of this?’’ Judge Barker said in handing down her sentence.

Truong has also pleaded guilty and will be sentenced at a later  date.

Newton and Truong gave an interview to a local ABC reporter in Far North  Queensland in 2010 on their battle to have a child as a gay couple. Their search  started in 2002 in the US, where they both were working, and when they did not  have any success Truong travelled to Russia and found a woman who they ‘‘clicked  with personality-wise’’. She was paid $8000 and, as per their agreement, granted  the couple sole custody of the boy, handing him over five days after his birth  in 2005.

The family planned to live in Cairns but that was delayed because Australian  authorities initially refused to grant the child a visa. That took 2 years and  upon their eventual arrival in Australia they said Customs quizzed them for  hours. Police were also sent to the family’s house in Cairns to check up on the  pair.

In the radio interview, 20 months before their arrest, Newton was asked if he  felt the extra attention was because authorities suspected there was ‘‘something  dodgy … something paedophlic going on here?’’

‘‘Absolutely, absolutely, I’m sure that was completely the concern,’’ Newton  replied.

Evidence before the court revealed the abuse began before the couple returned  to Australia. One video is said to show Newton performing a sex act on the boy  when he was less than two weeks old.

Judge Barker said the pair brainwashed the child to believe the sexual abuse  was normal. Newton was also said to have trained the boy to deny any  inappropriate behaviour if he was ever questioned by authorities.

Newton and Truong came to the attention of police in August 2011 after their  connections to three men arrested over the possession of child exploitation  material came to light. The couple had visited the three men in the US, New  Zealand and Germany with their son.

While the couple were visiting family in the US, Queensland police searched  their Cairns home and found enough evidence to alert their US counterparts who  raided their Los Angeles base and took the boy into custody.

Newton and Truong claimed they were being targeted because they were  homosexual. However after his arrest in February 2011, Truong gave investigators  the password to the computer hard drives police had seized. It detailed the  years of abuse.

The boy remains in the care of extended family in the US.

People Died, Obama Lied

An anonymous State Department official told the Associated Press last Tuesday: “That was not our conclusion” — namely, that a notorious YouTube video that lampooned the Islamic prophet Mohammed unleashed deadly mayhem upon America’s consulate in Benghazi, Libya.

This denial should shock anyone who watched the news after U.S. ambassador J. Christopher Stevens, Foreign Service officer Sean Smith, and former Navy SEALs Glen Doherty and Tyrone Woods were murdered on the eleventh anniversary of September 11. That anti-Islamic video’s culpability certainly was the “conclusion” among top administration officials, including President Obama. They fingered the video for eight days, even as evidence mounted that these Americans were slain in a commando-style operation that involved machine guns and mortar shells, not banners and placards.

As Fox News Channel’s Bret Baier and Bill O’Reilly each detailed on Wednesday, Team Obama energetically promoted this now-repudiated “conclusion.”

September 11: Despite anti-video demonstrations in Cairo, Benghazi is tranquil. According to diplomats, “everything is calm. There’s nothing unusual. There has been nothing unusual during the day at all outside. No protests all day.”

At 9:40 p.m. local time, however, gunfire and explosions rock the consulate’s front gate.

September 12: As these homicides become clear, President Obama says, “We reject all efforts to denigrate the religious beliefs of others, but there is absolutely no justification to this type of senseless violence. None.” Obama then skips his daily intelligence briefing and jets to a Las Vegas fundraiser.

September 13: “The United States government had absolutely nothing to do with this video,” Secretary of State Clinton declares. “We absolutely reject its content and message.” Repeated efforts to distance the U.S. government from the video actually publicize it. Paradoxically, it grows increasingly toxic.

September 14: “We have no information to suggest that it was a pre-planned attack,” White House press secretary Jay Carney announces. “The unrest we’ve seen around the region has been in reaction to a video that Muslims, many Muslims find offensive.”

That day, as the murdered Americans’ remains reach Andrews Air Force Base, Clinton says: “We have seen rage and violence directed at American embassies over an awful Internet video that we had nothing to do with. It is hard for the American people to make sense of that because it is senseless.”

September 16: United Nations ambassador Susan Rice tells Fox News Sunday that “this was not a pre-planned, premeditated attack.” She calls it “a spontaneous reaction to what had just transpired in Cairo as a consequence of the video.”

September 18: “You had a video released by somebody who lives here, sort of a shadowy character, who has an extremely offensive video directed at Mohammed and Islam,” President Obama tells comedian David Letterman. Obama adds that “extremists and terrorists used this as an excuse to attack a variety of embassies including the consulate in Libya.”

September 19: Team Obama abruptly changes tune. National Counterterrorism director Matthew Olsen informs the Senate Homeland Security Committee, “I would say yes, they were killed in the course of the terrorist attack on our embassy.”

September 20: “It’s self-evident that what happened in Benghazi was a terrorist attack,” Carney announces. Somehow, this self-evidence had eluded the public.

Why would Team Obama essentially accuse a video of these murders, even as Lieutenant Colonel Andrew Wood — leader of a 16-man, dedicated military unit withdrawn from Libya last August — called the hit “instantly recognizable” as terrorism?

During President Obama’s difficult campaign, that fantasy was far more palatable than this reality: A premeditated, well-executed al-Qaeda strike on a U.S. mission eradicated four Americans, even after they longed for the security assistance that might have prevented them from coming home in caskets.

Ambassador Stevens warned Washington that Libya “remains unpredictable, volatile, and violent.”

Eric Nordstrom, a former U.S. security officer in Libya, told the House Government Reform and Oversight Committee on Wednesday that State documented 230 security incidents in Libya between June 2011 and July 2012. Nordstrom consequently requested twelve more security personnel.

“‘You are asking for the sun, moon and the stars,’” Nordstrom says a State Department regional director complained. Nordstrom then describes his greatest frustration in this assignment.

“It is not the hardships,” Nordstrom says. “It is not the gunfire. It is not the threats. It is dealing and fighting against the people, programs, and personnel who are supposed to be supporting me.” As he told that regional director, “For me the Taliban is on the inside of the building.”

Nordstrom ultimately concluded that “we were not going to get resources until the aftermath of an incident. And the question that we would ask is again, ‘How thin does the ice need to get until someone falls through?’”

These inconvenient truths would have obviated Team Obama’s “bin Laden is dead, al-Qaeda is comatose” reelection theme. Thus, the same government that apparently leaks secrets to make the president look tough evidently oozed falsehoods to keep him from looking weak.

In short: People died, Obama lied.
