“There is no substitute, none, for American power,” the general said, to occasional cheers and ultimately a standing ovation from a crowd of special operators and intelligence officers at a Washington industry conference.

He also slammed the administration for refusing to use the term “Islamic militants” in its description of ISIS and al Qaeda.

“You cannot defeat an enemy you do not admit exists,” Flynn said.

He said the administration is unwilling to admit the scope of the problem, naively clinging to the hope that limited counterterrorist intervention will head off the ideological juggernaut of religious militancy.

“There are many sincere people in our government who frankly are paralyzed by this complexity,” said Flynn, so they “accept a defensive posture, reasoning that passivity is less likely to provoke our enemies.”

Flynn refused to name President Obama as the focus of his ire in comments afterward to The Daily Beast, saying that he was simply “sending a message to the American people.” But the comments show the widening rift between some in the national-security community who want to see more special-operations and intelligence assets sent into the fight against ISIS and other groups in Syria and beyond.

.. there are several sources that indicate that the entire agreement [as it stands] has NOT been presented to the U.S. Congress . How do we know ? Congressman Pompeo and one of his senate colleagues [I am not sure who] were inadvertanly briefed by the IAEA and the US in Switzerland during the final negotiations . Also , there were classified briefings of members of Congress . Those briefings indicate that there are side deals , the existence of which has not been publically disclosed . So we know the truth …

That review period was supposed to take 60 days and is triggered the day the president submits the agreement to Congress. However, because the president failed to submit the agreement in full, as the law requires, the 60-day clock has not started, and the president remains unable lawfully to waive or lift statutory Iran-related sanctions. Indeed, since the act also provides for the transmittal of the agreement to Congress between July 10 and Sept. 7, the president’s ability to waive statutory sanctions will remain frozen in perpetuity if Congress does not receive the full agreement Monday .

Congress must now confront the grave issues of constitutional law prompted by the president’s failure to comply with his obligations under the act. This is not the first time this administration has disregarded clear statutory requirements, encroaching in the process upon Congress’s legislative and budgetary prerogatives. The fact that this has happened again in the context of a national security agreement vital to the United States and its allies makes the situation all the more serious.

For Congress to vote on the merits of the agreement without the opportunity to review all of its aspects would both effectively sanction the president’s unconstitutional conduct and be a major policy mistake. Instead, both houses should vote to register their view that the president has not complied with his obligations under the act by not providing Congress with a copy of an agreement between the IAEA and Iran, and that, as a result, the president remains unable to lift statutory sanctions against Iran. Then, if the president ignores this legal limit on his authority, Congress can and should take its case to court.

An Open Letter to the Leaders of the Islamic Republic of Iran:

 

It has come to our attention while observing your nuclear negotiations with our government that you may not fully understand our constitutional system.  Thus, we are writing to bring to your attention two features of our Constitution—the power to make binding international agreements and the different character of federal offices—which you should seriously consider as negotiations progress.
First, under our Constitution, while the president negotiates international agreements, Congress plays the significant role of ratifying them.  In the case of a treaty, the Senate must ratify it by a two-thirds vote.  A so-called congressional-executive agreement requires a majority vote in both the House and the Senate (which, because of procedural rules, effectively means a three-fifths vote in the Senate).  Anything not approved by Congress is a mere executive agreement.
Second, the offices of our Constitution have different characteristics.  For example, the president may serve only two 4-year terms, whereas senators may serve an unlimited number of 6-year terms.  As applied today, for instance, President Obama will leave office in January 2017, while most of us will remain in office well beyond then—perhaps decades.
What these two constitutional provisions mean is that we will consider any agreement regarding your nuclear-weapons program that is not approved by the Congress as nothing more than an executive agreement between President Obama and Ayatollah Khamenei.  The next president could revoke such an executive agreement with the stroke of a pen and future Congresses could modify the terms of the agreement at any time.
We hope this letter enriches your knowledge of our constitutional system and promotes mutual understanding and clarity as nuclear negotiations progress.

Funding Hamas is a direct violation of United States law:


(a) Prohibited Activities.—

(1) Unlawful conduct.— Whoever knowingly provides material support or resources to a foreign terrorist organization, or attempts or conspires to do so, shall be fined under this title or imprisoned not more than 15 years, or both, and, if the death of any person results, shall be imprisoned for any term of years or for life. To violate this paragraph, a person must have knowledge that the organization is a designated terrorist organization (as defined in subsection (g)(6)), that the organization has engaged or engages in terrorist activity (as defined in section 212(a)(3)(B) of the Immigration and Nationality Act), or that the organization has engaged or engages in terrorism (as defined in section 140(d)(2) of the Foreign Relations Authorization Act, Fiscal Years 1988 and 1989).

On Wednesday, a day before the kidnapping, 88 senators sent a bi-partisan letter to the Obama administration demanding that the United States cease its assistance to the government:


Dear Mr. President:

We are appreciative of your Administration’s dedication to achieving a two-state solution to the Israeli-Palestinian conflict. Unfortunately, the recent formation of a Palestinian Authority unity government supported by Hamas, a designated Foreign Terrorist Organization that has never publicly accepted the Quartet principles, represents a serious setback to efforts to achieve peace. We are gravely concerned that the formation of this government and President Abbas’ renewed effort to upgrade the status of the Palestinians within international organizations will jeopardize direct negotiations with Israel to achieve a two-state solution.

By its actions and inaction, Hamas has demonstrated it is not a partner for peace. Hamas has openly called for Israel’s destruction and last month Hamas leaders again repeated their refusal to meet recognized international demands: recognition of Israel, renunciation of terror, and acceptance of previous Israel-PLO agreements.

Recent events have consequences as to U.S. assistance to the Palestinian Authority as provided for in the Palestinian Anti-Terrorism Act of 2006 and restrictions contained in the Omnibus Appropriations Act of 2014, including prohibiting foreign assistance to Hamas or any power-sharing government of which Hamas is a member or over which Hamas has undue influence. These troubling developments, including the role played by Hamas in the formation of the government, have undermined Congressional support for U.S. assistance to the Palestinians. Any assistance should only be provided when we have confidence that this new government is in full compliance with the restrictions contained in current law. We urge you to continue to impress on President Abbas the need for him to cease any alliance with terrorist organizations such as Hamas and to return to the negotiating table with Israel.

.. good question . the folks who have worked at Executive Branch Agencies are subject to subpoena . They will be invited to testify . If they show the slightest inclination to stall , then Wham ! . Out comes the subpoena ! ..

However , if the Executive Branch stalls , as is the case already , a subpoena could well be possible . .. Andrew was being interviewed by Megyn Kelly on the Kelly File the other night . Andy nailed the ObamaaCrap Administration because of his contacts  throughout the law enforcement community . Those contacts revealed that the D.H.S. and the ObamaCrap Department of InJustice were playing fast and loose with the numbers of people actually being deported …. and that so many of those being arrested were being released back on the street , almost as if there were a ” waving olé  ” approach to border security enforcement …

.. ya need to see Congressman Trey Gowdy go at it with Holder . Holder was never a prosecutor . However , Gowdy was before he was elected to Congress . So he knows more than a little on the subject of discretion and power …

It’s this exchange that caught my attention:

GOWDY: That’s my point, is that your memo is trumping a congressional statute.

HOLDER: Well, I mean, we always have discretion. And, would you say that…

GOWDY: But you don’t have discretion on whether to the follow the law or not. That’s my point.

HOLDER: No, no, I would disagree in the sense that, taking into account resource constraints, it is incumbent upon those of us in the executive branch to make the maximum use of the resources that Congress gives to us. That necessarily means we’re always making choices about the kinds of cases we bring, how we deal with cases we bring…

GOWDY: But you’re already expending the resources of the prosecution or you and I wouldn’t be having the question. This is all about sentencing. I have no qualms if you say I’m gonna decline prosecution. You have an unfettered right to do that.

What I’m saying is you don’t have the right to say, in mandatory minimum cases, don’t tell the grand jury what the drug amount is.

Holder believe his ‘discretion’ gives him the power to ignore the law as long as he can cite ‘resources’ as the excuse. This is exactly the argument Obama is using regarding deportation of illegals. They ignore congressional law and claim they don’t have the resources needed to fully enforce the law. In reality they are pushing their own agendas which, in this case, is trying to keep minorities out of prison even when drug amounts are severe enough that the law demands prison time.

I would add that Holder also seems fairly outmatched in this debate with Gowdy, as he confuses prosecution and sentencing. Not only does Gowdy expose Holder’s motives, he also exposes what a light weight Holder is when it comes to defending his lawlessness.

.. Holder seems to think that he has unlimited discretion in enforcing the law . No he does not . The overall principle is that he needs to remember that he has to enforce the ” body of law ” as a whole . He may have discretion as to the what and how , but not to discretion that makes policy changes that , in effect , change the meaning of laws passed by Congress ….
