… the Obama Administration has , through the Dept of HomeLand Insecurity, its law enforcement co – operation agreements with the state of Arizona , as a result of the Supreme Court ruling…

…. failing to do their job is bad enough …chicken [bleep] political retaliation is waaayy worse…

… if Obama/Biden had any real thoughs of carrying Arizona , they can forget it . the dems in AZ are not happy with their Republican bretheren and sisteren, but they would likely be furious with the ObamaCrap Administration for pulling this kind of stunt …

Israel vs Iran

… if i were PM Netanyahu , i would not trust Vladimir Vladimirovich any more than i would Barack Hussein (obama) …

… i believe Israel will strike Iran, and soon. How soon? God only knows, but it will likely be before Labour Day (and the Convention(s))..

…Israel does not have the military oomph that we in the US do , but the Israelis have a National Command Authority (Bibi) with “balls,” which we do not…

…Netanyahu will wait as long as he can, but he will go, whether our government or the Russians, the British, the French, or anyone else likes it or not,…

… and when it starts, katey bar the door, because the guns of summer will fly all over the place ….

  Well, the Supreme Court has ruled, and it is a split decision…the justices ruled 8-0 [kagan did not participate] that AZ police could pull over suspected “illegals” (if there was other reasonable) justification, and ask for their papers…

  However, the other 3 part of AZ sb 1070 ere tossed out…one can understand, to a point that the feds define and control immigration…that is, when they get off of their rear ends ,  and enforce the gosh darned law…

  AZ and other states would not be forced to take up the immigration cudgel without good to feds — get back in the fight, and enforce the law…

  ….should the national immigrational law be reformed ? Yes . Massively ? No . Retooled ? most defintely . should there be more legal immigration ? i belieieve that there should be , and that it should be rebalanced , with Europe , Africa , South America , and the Carribean Nations getting more of a shot …also , the share of immigration from Asia should be rebalanced from Japan , China, Korea, et al , to the other nations , to give them a fairer shake …

  …. First and Foremost , protect and secure our borders . No immigration reform makes any sense without it ….

Part 4 — Medicaid

  this part is very esoteric to most folks , but it is quite simple. the ObamaCrapCare Act is seeking to dragoon our states and blackmail them into adding millions of people to the Medicaid rolls, with little (3 years) aid from a Federal Government that cannot afford it.

  Also, in particular many states either have just or are about to get their financial books back in balance, and adding so many people (as the Mother of All Unfunded Mandates) is going to put them effectively into bankruptcy, or pretty close to it.

  If the whole bill (part 3) comes about, then the states will not have to worry, but even if it does, i believe that the Supreme Court will decide on this part of the case, nonetheless. They would not have set things up this way, if they were not planning to make a decision.

  I am not entirely sure, but I think that they will decide (5-4, or 6-3) to strike this part down. Having states meet financial requirements for aid from the feds is one thing, but dragooning them into effective bankruptcy by threating their ENTIRE Medicaid funding is something else .

Part 3 — the Bill [as a whole]

…this is a whole lot touchier situation to cross…

…the Court is likely (i think) to toss out the individual mandate, but the whole bill ?? that , i am not so sure…Associate Justice Scalia put it best that “do you want the massive migrane headache(s)” from going through the bill to determine what stays, and what goes ?

…why this situation? the mandate is the funding mechanism for the rest of the bill. if the mandate goes, then the health insurance industry in this country is finished without the rest of the bill being taken out. leaving the rest of it in place will put it into ” death spiral ,” where its costs will spiral out into earth orbit, with little chance to recoup enough in revenues…

….in this case, i think that it will be a 5 to 4 decision [Kennedy,Scalia,Alito,Roberts,Thomas]. This element may pick up Breyer or Sotomayor, but only with them “holding their nose…”

Part 2 — the Individual Mandate

  I am the most certain about this part of the case … Ginsberg & Kagan will stick w. the govt, possibly Sotomayor, but I think Breyer will side with Kennedy & the conservatives [Roberts,Alito,Thomas,Scalia]…thus, a 6 – 3 ruling that the individual mandate is unconstitutional…

  philosophically, how can the government justify forcing each and every one of us into the marketplace of commerce, then to force us to buy a product w. the govt’s stamp of approval…basically, the sphere of interstate commerce…

  the late Chief Justice of the United States William Rehnquist put it the best in the case of Lopez v. US (1995) that Congress cannot stretch the Commerce Clause of the US Constitution like “a rubber band” to justify its action(s)…

Part 1 — the Anti Injuction Act

  the first part of the case is the government ‘ s challenge that the fees are “taxes,” and that the Anti Injuction Act applies…

  this act was passed in the aftermath of our Civil War..It basically says (i think) that you cannot challenge the imposition of a tax until the tax takes effect. then you can attack it…well, that is, depending on whether one thinks that the fee(s) imposed from the mandate are taxes, instead of penalties…

  I do not…They are penalties, plain and simple…the Anti – Injunction Act does not apply..

  well , the U. S. Supreme Court should be coming out with its ruling(s) on Monday or Thursday of the coming week. and, you had better believe that they are bloody well important.

  the first one is the Arizona Immigration case. The law (AZ SB [Senate Bill] 1070]) was very carefully crafted to dovetail with federal law. and local law enforcement can, within limits, can enforce that law.

  that is what the AZ law was designed to do…and what the gawd awful abusive challenge by the ObamaCrap

Department of InJustice was designed to do to scare other state(s) off… Well, it has not worked…

  Well, y’all wonder what i think? I think that the AZ law will be upheld, more than likely 6 – 3, or possibly even

7 – 2. RB Ginsburg is hopeless, and Elena Kagan is almost as bad…
