.. as joel Gehrke puts it , POTUS made a real blunder in going with his E.O. so early in the Lame Duck session . Because of it , the House can add the funding ban onto the appropriation bill , or even onto a Continuing Resolution . The C.R. can be made to only last partway through the Fiscal Year . Then , the Senate [and Dingy Harry] can be put in  a  real box ….

.. ergo , POTUS can be put into a real tough situation . Does he want to shut down the  government over his lawless  E.O. , or not . He just might , especially at ChristmasTime …

.. I have to admit , I did not see this coming . Mark Warner is a businessman , one who knows how to meet a payroll . He is also the richest DemoCrap in the Senate [up around $600 million in net worth] , so he can easily self – fund his campaign …

.. Ed Gillespie , the GOP nominee , is a veteran political operative . He has a huge bundle of political chits to cash in , so he can raise a fair bit of $$ for his own campaign . But , he has an uphill climb against Warner …

.. Gillespie will have some help . Virginia ‘ s legislative and state – wide elections are in odd – numbered years . So , the Senate race is the only statewide race . Gillespie and Warner will have to carry their own water , and each will have to make the sale …

.. it will be interesting to see these two go at it in a debate . She could avoid him , before all of this . Not now . She is going to have to debate him , several time . She has no choice …

.. I would think that WMUR [a big TV station in New Hampshire] would have double – checked the results on this one . I suspect that the Manchester Union – Leader and other media are going to run follow – up polls to see if this is an outlier …. or a trend …

.. businessman and columnist Bob Beauprez is already even with incumbent Colorado Governor John Hickenweenie [my pet name] at 44% to 44% . Ouch …

.. the other is Mark Udall , the Senate candidate — he is in a tight race of his own . Right now , he is trailing congressman Cory Gardiner 43% to 42% . That puts him in even worse shape than Hickenweenie ….

.. Both normally would want to get a boost from the other . Right now , that ain’t happening . At the moment , these two are tied like ball and chains around each other ‘ s necks . Unless one or the other pulls clear , which is unlikely for now , they are both going to struggle for weeks to come ….

.. campaign committees always reserve lots of air time . A great deal more than they will ever use . But , it will tell you much more than anything that those committees ever intended to .

.. [-] campaign committees carry a great deal of influence — good and great fundraisers are always in high demand . The larger the amounts that they can raise , the better their influence . Especially if they happen to have a tough race …

.. [-] they also have large purse strings — those committees have raised a lot of cash , $$ to be deployed . So , the party bigwigs want it to be spent wisely …

.. [-] where it is spent tells you a lot — these committees have requests for campaign $$ that are far in excess of their cash-on-hand , or what they expect to have . So , they have  to decide who to spend it on , and how much to use on each race . Those judgements will give you a relative guesstimate as to the odds of the campaigns possible success ..

.. [-] thse committees can be springboards for higher office — a highly successful campaign committee run can be extraordinarily useful to one ‘ s political future …

.. Cochoran is the senior US Senator from Mississippi . He has served 5 terms in the US Senate , and is seeking his 6th term . Before that , he had served in the US House since 1973 …

.. the Tea Party folks saw Cochoran , who is a bit more moderate than most think , as vulnerable . Going after a sitting US Senator is never easy . For those who go after one in a party primary , one must have a death wish …

.. Well , the Tea Party folks turned out to be right . Conservative businessman and Tea Party favourite Chris McDaniel won the primary , but , unfortunately , just missed winning it outright . McDaniel won about 49.8% of the vote , to Thad Cochoran ‘ s 48.9% . Since no one won an absolute majority , there will be a run-off election for the nomination …

.. Do not fret , GOP . Short of an absolute disaster , the winner [my guess would be McDaniel] will be an enormous favourite in November. Mississippi is about as Red a state as you can get , especially in the South …

.. Carr is running in Ca33 , which is Henry Waxman ‘ s old seat . Waxman is retiring after decades [almost 40 years] in the House . This seat is about as liberal as it gets . Apart from Manhattan ‘ s Upper West Side , there are not many places quite like LA ‘ s west side … Brentwood , BelAir , Beverly Hills , and Malibu , up to Santa Monica . The usual job description for a Congressman is GOPers need not apply …

.. For any Republican to have a real chance , it helps to be Jewish . Carr is , and is Conservative Jewish . That helps , because an Orthodox Jew would be dead meat in this district . Reform Judaism , which is likely strong in this district , may well be willing to support a Conservative jew , especially a businessman and a war veteran ..

.. Richmond – area local economist David Brat (what a nice name!) shocks Eric Cantor , and handily at that . The margin was almost 11 points , 55.5 % to 44.5% . Yes , it was that much . The $$ primary was even bigger …

.. Cantor raised nearly $ 5.5 million , and spent almost $ 5.3 million . Brat raised ONLY $250k , and spent about $225k . Only that much . Yet , in a district that is normally favourable to order for Cantor , Cantor is now out on his rear …

.. the power dynamics in D.C. are going to be fascinating . No , the House Dems do not practically have much of any chance to take back the place . They just don’t . Especially with POTUS ‘ jackass stunts , and likely more to come . The DummyCraps have enough problems as it is , especially with an extremely unpopular President roped around their necks …

.. He is a candidate for US Congress from California ‘ s 52nd Congressional District . He will stand for election on Tuesday in the state ‘ s ” jungle ” primary , where all comers stand for election . Only the top two vote – getters move on to the general election on November 5th …

.. He made the news again this week . Unfortunately , it was of the not-so-good kind . His campaign headquarters in San Diego was vandalized and totally trashed by parties unknown . Given the tactics of the current campaign , people suspect the campaign of his opponent , demoCrap Representative Rob Peters or gay rights interest groups in the Greater San Diego area . How foolish would that be , especially just before the election …

In this race , the important thing will be , first , who gets through [likely deMaio and Peters] . Second , is what vote totals that they get . So , why is the vote important ..

.. Quinn is trailing his GOP opponent , financier Bruce Rauner , and has probably one of the worst governing records ever for any Governor who has not been convicted of a crime . A columnist wrote a column comparing black Republicans to Jewish folks in Germany who collarborated with the Nazis . Dumb , isn’t it …

.. Boy , did it ever bomb . It created an uproar in Illinois’ Jewish community , especially in Cook County . They did not like the column as it was , and they disliked Quinn ‘ s endorsement and support of it even more . Quinn and his people quickly disavowed it , and withdrew the tweet . Unfortunately in the Internet Age , the damage has been done . Oh boy , has it ever …

.. Julie Boonstra is the Michigan woman who has gotten involved in the Americans for Prosperity campaign against a US Senate candidate in her home state . She got involved because ObamaCrapCare turned her health insurance coverage and health care status upside down and inside out .

.. besides fighting for her life , what could she do : fight back …. so , she did …. and how . It seems that her ads have been quite effective , as GOP Senate candidate Terri Lyn Land has taken a nearly 10.0% lead in the polls against her probably DemoCrap oppoonent . Especially since neither Land nor Democrap Gary Peters [who is a Congresscritter] have been advertising all that much on T.V. …

… Why I support Arizona ‘ s Religious Freedom Bill …

.. and I most strongly urge Governor Jan Brewer to sign it .

..  one of the chief reason is to make sure that people get to celebrate their religious liberty — and are not forced to be compelled to produce a product or service against their will . Just because people go into business does not mean that they forfeit their constitutional rights . They still have the right to make decisions in their business based upon their religious faith and religious precepts . The First Amendment to the Constitution should still mean something in practical everyday use .

.. What is going on in New Mexico , Oregon , Washington State , and Colorado , among other states , is that each state has passed a so – called ” human rights ” law , incorporating gays and lesbians into its orbit . As a result ,  these laws have become to be used as a war club by pro gay rights activist in going after businesses that refuse to serve gays or lesbians . More often than not , this has been in the area of so – called same –  sex wedding celebrations . When the business says no service , the gay rights folks sue for discrimination . Because of this legal mess , the businesses have to pay ruinous legal fees just to have the chance to remain in business . Some cannot . An Oregon cakeshop ceased doing business in the normal fashion , the  owners retreating to their home as a home – based business as a result . How sad , and how outrageous .

.. Activist judges have been taking the law into their own hands , such as with gay and lesbian rights . These anarchist judges have pushed the envelope far , far ahead of things than many of us in society want to happen or expect to  happen . Yet , they still do this . What are these folks doing , casting tiddly winks ? Hardly . They are making law from the bench ,  which is not their job .

.. In addition , interest groups and others are using two laws , one well known (section 1983 of the Civil Rights Act) and one unknown (the Civil Rights Attorney Fees Act of 1976) to bash so many folks over the head with a billy club . These loonie – toons practice what is known as lawfare , using the threat of ruinous legal fees , plus the payment of the plaintiff ‘ s judgement and legal fees , in order to compel a settlement . Nowadays , this weapon is being turned potentially against churches ….

.. Arizona undoubtedly has a law like this . They have seen what has been going on in neighboring states , including the Elaine Photography case in New Mexico . The dilemma in Arizona that the lawmakers have to think about is this : Should someone be compelled to produce a product or service for something that they do not support (such as same – sex weddings ,  same – sex adoptions , you get the idea) as in the Elaine Photography case , based upon sound religious reasons ,  in violation of their First Amendment rights to freedom of religion and religious practice ?

.. I say no . These states are pushing the acceptance of same – sex acts on at times an unwilling populace . If people are not comfortable doing so , and it is because of religion and religious faith , then they should not be forced into an accomodation with others . Also , the state is forcing ” compelled speech ” by doing this . Doing such a thing is in gross violation of the First Amendment rights of the defendants . Also , the interest groups make it all but impossible for folks to defend themselves because of their lawfare strategy . Giving people their religious rights once again gives them the chance to defend themselves .

.. this bill has been proposed in Ohio , I believe . The legislature can pass it , because the votes are easily there [61-38 in the State House , 23 – 10 in the State Senate] . The big question is Governor Kasich . This year is an election year , and he is on  the ballot . He probably does not want to give gays and lesbians any ” bulletin board ” material with which to play with on the political trail .

.. Ohio is an initiative and referendum state . Yes , that means gays and lesbians could mount a issue campaign to put the bill before voters . However , if the bill is approved with 3/5ths support [60 in the House , 20 in the Senate] , then no campaign is allowed . The bill would be considered an ” emergency , ” and would take effect immediately ..

.. No , not on the receiving end of charges … I brought charges against a fellow student for misconduct . I was not entirely satisfied with the outcome , but I should not have been … At least the other fellow had a chance to defend himself . In cases like these , especially involving sexual assualt and / or rape allegations , the ” star chamber ” of college discipline can turn into a circus …

Prof. KC Johnson, best known for his investigative work regarding abysmal university and faculty handling of the Duke Lacrosse case, has a post at Minding the Campus regarding a disturbing appointment at Dartmouth, ‘Why Have a Hearing? Just Expel Him’:

“Why could we not expel a student based on an allegation?” That astonishing question was posed at a conference on how colleges respond to sexual assault issues by Amanda Childress, Sexual Assault Awareness Program coordinator at Dartmouth. According to Inside Higher Ed, Childress continued: “It seems to me that we value fair and equitable processes more than we value the safety of our students. And higher education is not a right. Safety is a right. Higher education is a privilege.”

Give Childress credit for candor–even the campus spokespersons for increasing the number of guilty findings in campus tribunals usually aren’t so bald in their disdain for basic principles of due process.

Childress’ jarring remarks coincided with news that Dartmouth had promoted her, and given her additional power over the college’s sexual assault policies. Last Friday, the college announced that Childress will head the newly-created Center for Community Action and Prevention, which Childress said would “be the focal point on campus for Dartmouth’s sexual assault and violence prevention initiatives” and “drive the College’s mobilization efforts around preventing sexual violence and increasing the safety and well-being of all members of our community.” (All members, it seems, except students facing unsubstantiated allegations of sexual assault.) Incredibly, Dartmouth theater professor Paul Hackett suggested that despite Childress’ appointment, the college isn’t going far enough on the issue.

To reiterate: one of the nation’s elite colleges thinks it’s a good idea to enhance the power of a figure who wonders about the propriety of expelling possibly innocent students based solely on an allegation.

The victims of these ideologically-driven star chambers almost always are men.

Prof. Johnson notes a troubling case at Swarthmore, one in a long line of alleged campus witch hunts against men gone bad:

The Swarthmore lawsuit, first reported by Philadelphia, shares similar characteristics to suits filed against Vassar, St. Joe’s, and Xavier–but with one interesting twist. According to the filing, the accuser waited 19 months to file her charges (she never went to police or had a medical exam); the weakness of her case was such that even Swarthmore’s biased disciplinary system didn’t bring charges against the accused students. But two weeks after the Title IX complaints, Swarthmore reopened the case–and within less than a month, had completed its investigation, held a hearing, and completed the expulsion. The lawsuit alleges that Swarthmore failed to respect what passes for due process on the campus; the student’s attorney claims that Swarthmore didn’t give the student a right to respond in writing to the charges, among other things.

It’s time for universities to get out of the prosecution business.

Sexual assault is a crime. If a college student — female or male — believes she or he is the victim of sexual assault, the remedy should be filing a police complaint. Only at that point should a university even consider expulsion or other discipline, and not as punishment (until the criminal case is resolved) but exclusively for the protection of other students (as for any other violent crime) and only with a strong measure of due process.

Requiring the filing of a criminal complaint serves multiple purposes. Filing a false criminal complaint itself is a crime, so it increases the likelihood that the filing is in good faith (although it’s no guarantee). The filing of a criminal complaint then triggers a variety of procedural protections.

.. LEC here again — No matter whether it is a state – run or state – supported school , or a private institution , these young people need and deserve due process . These kind  of allegations can be ones that do significant damage to their lives , if not destroy them , in matter of fact …
