.. but not this time ..

.. the Ok legislature adopted this bill with virtually no debate , and in a great deal of haste . When you want to pass a bill , you usually want to promote the subject in order to build support . When you want to pass a bill , you should want to debate the bill ‘ s merits in public . One should not be afraid of debating a subject that one strongly believes in , not ever . So do not do so in haste ..

.. The Oklahoma legislature did so in haste . Governor Mary Fallin had a tough decision . Sign the bill , or veto it ..

.. she chose the latter course of action . She vetoed the bill . I applaud her choice ..

.. remember , I am a strong pro – lifer . But you should not pull a ” dead of the night ” stunt like this in order to make progress on our cause . It is wrong ..

.. he is the current Governor of West Virginia .

.. he has something that no Gv has had to deal with in three quarters of a century : a GOP – controlled legislature …

.. for West Virginians , that will take some getting used to . Tomblin has to get used to it now , and in the near future …

.. Tomblin probably wants to run for re – election . One big problem : he is a DEmoCrap in what is now a Red State . Whoever he faces in 2016 , he is going to have Barack Obama and his ” War on Coal ” policies wrapped around his neck like a millstone …

.. Tomblin is a bit of a klutz of a politician . Joe Manchin , he is not . So , the environment is going to be a tad challenging . So will the legislature . Especially the legislature …

.. the GOP – controlled legislature is going to want to start to rip out the legacy of the last three – quarters of a century , while giving coal and fracking a chance to rebuild and build [respectively] …

.. there are 6 major shale gas formations in the U.S. . In the east , Ohio and West Virginia sit on top of two of them : the Marcellus and the Utica . So , energy will be a part of WVa ‘ s future . But how ….

.. fortunately , Wisconsin is not a petition / referendum state . If it were , then the pro – labour forces could seek its repeal at the polls . Fortunately for Wisconsin , it is not so . Once the legislature passes the bill , and the Governor signs it into law , then it would become the 25th right to work state …

.. great for them . It will allow their workers a great deal more freedom from the tyranny from big labour bosses , and allow them to keep much more of their paychecks . Ergo , then the choice on whether or not to join a union becomes theirs , not the labour union ‘ s . They will not be forced to join a union local against their will …

… An Interesting Spectacle in Washington State [#school funding case]…

.. but , for once , even the DemoCraps are pissed at the State Supreme Court . I do not blame them …

.. they are learning that there is a cost to the fantasyland dreams of the Supremes . Especially when there Is a real – world impact on the cost of programs that they want , and the voters ‘ willingness to pay for them …

.. fortunately for Washington state , unlike many states in this situation , they have the initiative and referendum method of petitions . If the voters get too pissed , then Washington state government could be turned upside down in order to rein in the State Supreme Court …

.. it also is a campaign issue , whether the Justices are appointed or elected . It is the case because then the folks responsible for the appointments or elections can be held responsible for their actions …

.. — update — my home state of Ohio went through this about 20 years ago . Thankfully , the great mass of the legislature [mostly GOP , but a fair # of Dems] finally had enough of the State Supreme Court ‘ s antics . The activist justices either retired , or were ” retired ” in  an election . Their activist ruling was a chief issue in their undoing ..

.. Also , Ohio is an initiative / rererendum state . Even if the State Supreme Court had wanted to impose a sweeping mandate on the legislature , the voters would have rebelled , and placed an initiative on the ballot to repeal their activist stunt . That is , if  the legislature did not impeach and remove the justices first …

.. and Terry McAuliffe is in big trouble …

.. this is a repeater for me . The Dems in the Virginia legislature screamed bloody murder over this guy [Phillip Puckett] being offered a state job , and his daughter a judgeship , if he would resign from THE Va Senate . The thing is that Puckett ‘ s resigination flipped the Viginia Senate over to GOP control …

.. to their horror , the McAuliffe administration [he , the Lieutenant Governor , and the AG , Mark Henning] are all embroiled in it . They knew about the job offer , or had to know about it . Henning should well be investigating it , but it is now a federal probe , but ….

.. and , it is the Washington ComPost that uncovered it . Oops . Basically , McAuliffe is a dead man walking . He is gone . Va legislative elections are next year , and part of the debate will be the ” I ” word [impeachment] . McAuliffe will go , he will have to . If he does not , then the legislature will kick him out . The LG , too …

.. presuming A] the California legislature would approve (it just might) , and B] the US Congress would approve (doubtful) , Ca would split into 6 pieces …

.. 3 largely GOP …

.. Jefferson (the north) , South California (the Inland Empire , south through San Diego County) , and Central California (the vast farming region in the center of the state) . I include Central Ca in this given the damage that the ecosocialists in Sacramento have done to the farming region . Set free , they can run their own affairs …

.. 2 largely DemoCrap …

.. West Ca (LA and the surrounding area to the north , including Santa Barbera) , and Silicon Valley (duh!) , and

.. 1 largely fair fight …

.. North Ca (the mountainous area between Jefferson and Silicon Valley) ..

.. who knows what may happen ? . It will likely be on the ballot in 2016  , which is a presidential year . However , the turnout , given California ‘  s current status , is  likely to be lousy . So  , this issue , especially if it has the field largely to itself , could have an interesting battle …

… What Judge would Do This ? …

.. this action was taken by a judge in response to a lawsuit .

.. Connecticut gun owners have been burdened by a new law that was passed post – Sandy Hook that acts to ban guns and limit munitions . This judge has forgotten about pending judicial precedent , such as Heller and McDonald v City of Chicago . So , this activist judge allowed the new law to stand …

.. what is amazing is that these activist judges fail to read the Constitution , specificially the Second Amendment . They also tend to forget that the Bill of Rights , taken as a whole , is a body of law that is desgined to protect Individual rights , not collective rights , such as those of groups of so – called protected classes .

.. The entire Constitution is itself written and designed to protect the rights of the individual against the actions of the state and the government . That shoots down actions taken by those who try to interpret the Second Amendment to act a collective right . It is not that at all . It is a protection of the rights of the individual against the government , not the government against the indivual . So act to preserve the rights of the individual , and vacate this idiotic ruling …

… it is something that i have never heard spoken about , or debated about , on radio , on TV , or in the blogosphere …

… the individual mandate is a ” bill of attainder . ”

… a what ? …

… for those who do not know our Constitution , it is a provision of our learned document (Article 1 , Section 9) . It is an act of a legislature , in this case , Congress , that is meant to punish a person , or , a group of person , without the judgement of a judicial proceeding …

… in simple , the Mandate , acting as a penalty , is , i believe , a Bill of Attainder , and should have been thrown out on the spot by the courts , definitely by the U. S. Supreme Court …
