.. why did the packages that were sent via U.P.S. and FedEx end up being late ?

.. what do I think ? I think that FedEx and U.P.S. and the others got caught with their pants down . They misunderestimated both the amount of packages that would be ordered this Christmas season . As it turns out , I think that the total was up . Not waaaay up , but up a fair bit . It was not just that , however .

.. They goofed on the timing . Goofing on both elements means that they did not have the human capital [people] that they needed when they were needed . They also did not have the physical capital [planes , pipeline space] that was substantial enough . Because of it , they got caught with excess shipping in the pipeplines at the wrong time . Guess what the result was ?

.. Some stuff was late . It happens . It was a business mistake . People will have to answer for it , to be sure . It is not a legal action [a tort] which would leave them vulnernable to lawsuits .

.. Some idiots will file , though . They will be dismissed , evetually , but not after the companies incur some legal bills as a result . Oh , Well . That is why we need tort reform …

AUSTIN, Texas (AP) — A federal appeals court on Thursday ruled that most of Texas’ tough new abortion restrictions can take effect immediately — a decision that means a third of the state’s clinics that perform the procedure won’t be able to do so starting as soon as Friday.

A panel of judges at the 5th Circuit Court of Appeals in New Orleans said the law requiring doctors to have admitting privileges at a nearby hospital can take effect while a lawsuit challenging the restrictions moves forward. The panel issued the ruling three days after District Judge Lee Yeakel said the provision serves no medical purpose.

In its 20-page ruling, the appeals court panel acknowledged that the provision “may increase the cost of accessing an abortion provider and decrease the number of physicians available to perform abortions.” However, the panel said that the U.S. Supreme Court has held that having “the incidental effect of making it more difficult or more expensive to procure an abortion cannot be enough to invalidate” a law that serves a valid purpose, “one not designed to strike at the right itself.”

The panel left in place a portion of Yeakel’s order that prevents the state from enforcing the U.S. Food and Drug Administration protocol for abortion-inducing drugs in cases where the woman is between 50 and 63 days into her pregnancy. Doctors testifying before the court had said such women would be harmed if the protocol were enforced.

After Yeakel halted the restrictions, Texas Attorney General Greg Abbott had made an emergency appeal to the conservative 5th Circuit, arguing that the law requiring doctors to have admitting privileges is a constitutional use of the Legislature’s authority.

“This unanimous decision is a vindication of the careful deliberation by the Texas Legislature to craft a law to protect the health and safety of Texas women,” Abbott, a Republican who is running for governor, said in a written statement.  Lawyers for Planned Parenthood and other abortion providers had argued that the regulations do not protect women and would shut down a third of the 32 abortion clinics in Texas.

Twelve of Texas’ abortion clinics won’t be able to perform the procedure starting as soon as Friday.  In a statement Thursday, Planned Parenthood said the appeals court decision means “abortion will no longer be available in vast stretches of Texas . ”        “This fight is far from over,” Planned Parenthood President Cecile Richards said in the statement. “This restriction clearly violates Texas women’s constitutional rights by drastically reducing access to safe and legal abortion statewide.”

The court’s order is temporary until it can hold a complete hearing, likely in January.

When the case comes up for argument in front of the appeallate court panel in January (presumably , in front of the same judges) , the case can likely come after the entire district court ruling . The fact that the same judicial panel will hear the case bodes well for the subject material at hand …

D.C. . Even the zealots who want the team name changed have to understand it is easily a legitimate 1st amendment issue , regarding the team ‘ s nickname . The Deadskins are not the only team , nor the only sport with this issue .

.. Being in the nation ‘ s capital makes it a far larger political football . People from all walks of life are ticket holders of the team , so POTUS , just leave things be , and shut up …

President Obama says he’d think about changing the name of the Washington Redskins if he were team owner and knew the name offended people.

“People get pretty attached to team names, mascots,” Obama told the Associated Press, adding, “I’ve got to say that if I were the owner of the team and I knew that there was a name of my team — even if it had a storied history — that was offending a sizeable group of people, I’d think about changing it.”

He added, “But I don’t want to detract from the wonderful Redskins fans that are here. They love their team, and rightly so — even though they’ve been having a pretty tough time this year.

.. the Brotherhood is a criminal organization . As has been said , it is dedicated to the imposition of sharia law , and its own form of Islamic dictatorship . Naturally , it means that the MB would be in control of the country . But from where ? Cairo , or Teheran ?

.. Considering the history of the Brotherhood , I would think that they would take their marching orders from the mullahs in Iran . It would make the world and especially the Middle East , in particular , a far more dangerous place . Israel itself , would be in the cross – hairs .

.. Egypt is currently a U.S. ally . The way that the ObamaCraps are pissing on the Egyptians , that is very likely to change , even if the Egyptian military (which is an important political power base in its own right) remains in power . They may not feel that the alliance with the U.S. is worth it all that much anymore , and dump us . Picking up someone else would be tricky , though .

Egypt considers outlawing Muslim Brotherhood

CAIRO (AP) – Egyptian authorities are considering disbanding the Muslim Brotherhood group, a government spokesman said Saturday, once again outlawing a group that held the pinnacle of government power just more than a month earlier.

The announcement comes after security forces broke up two sit-in protests this week by those calling for the reinstatement of President Mohammed Morsi, a Brotherhood leader deposed in a July 3 coup. The clashes killed more than 600 people that day and sparked protests and violence that killed 173 people Friday alone.

Cabinet spokesman Sherif Shawki said that Prime Minister Hazem el-Beblawi, who leads the military-backed government, assigned the Ministry of Social Solidarity to study the legal possibilities of dissolving the group. He didn’t elaborate.

The Muslim Brotherhood group, founded in 1928, came to power a year ago when its Morsi was elected in the country’s first free presidential elections. The election came after the overthrow of autocrat Hosni Mubarak in a popular uprising in 2011.

The fundamentalist group has been banned for most of its 80-year history and repeatedly subjected to crackdowns under Mubarak’s rule. While sometimes tolerated and its leaders part of the political process, members regularly faced long bouts of imprisonment and arbitrary detentions.

Since Morsi was deposed in the popularly backed military coup, the Brotherhood stepped up its confrontation with the new leadership, holding sit-ins in two encampments for weeks, rallying thousands and vowing not to leave until Morsi is reinstated.

On Wednesday, security authorities swept through the two protest camps, leaving hundreds killed and thousands others injured. The violent crackdown sparked days of street violence across the country where Islamist supporters stormed and torched churches and police stations.

In the most recent standoff, Egyptian security forces exchanged heavy gunfire Saturday with armed men at top of a minaret of a Cairo mosque. The security forces fired tear gas, stormed the mosque and rounded up hundreds of Islamists supporters of Morsi who had been barricaded inside overnight.

The confrontations Friday – around a Brotherhood call for a “Day of Rage” – killed at least 173 people, said Shawki, the Cabinet spokesman. He said 1,330 people were wounded in the protests.

Egypt’s Interior Ministry said in a statement that a total of 1,004 Brotherhood members were detained in raids across the country and that weapons, bombs and ammunition were confiscated with the detainees.

Among the dead Friday was Ammar Badie, a son of Brotherhood spiritual leader Mohammed Badie, the group’s political arm said in a statement.

Also Saturday, authorities arrested the brother of al-Qaida chief Ayman al-Zawahri, a security official said Saturday. Mohammed al-Zawahri, leader of the ultraconservative Jihadi Salafist group, was detained at a checkpoint in Giza, the city across the Nile from Cairo, the official said.

The official spoke on condition of anonymity as he wasn’t authorized to brief journalists about the arrest.

.. A central bank ‘ s job is very simple , yet , equally complex . One of a central bank ‘s simplest jobs is dealing with inflation . Inflation in any economy is a very bad idea . The total abscence of inflation (or deflation) is also a very bad idea . Maintaining it at a low level , and a stable level , would be the best idea .

intervention come to mind , but they are not exclusively the only things a central bank does .
Another is the stability of the currency . This one is separate from the above .
A modern economy cannnot exist , in reality , without a currency . A modern economy cannot really be successful without a stable currency . Boring with a currency is better than lively .

.. There are some tasks for which a central bank does bear some responsibility . One is government finance . It does not bear the direct burden , as the Treasury Department handles that . Indirectly , it does . If it does not do its other jobs , then the government cannot finance its spending , or its debt . Another is the economy itself . Many millions and tens of millions of actions , each and every second , are the lifeblood of the economy . A central bank can choose to have a great deal of influence over the economy , depending on how it uses the tools that it has at its disposal . The injection of $80 billion a month in cash from the purchase of mortgage – backed securities is a classic example . However , that gravy train is coming to an end . The economy will have to stand on its own two feet .

.. Unfortunately , Barack Obama is clueless about the economy . How it works , what capital is , how it is raised and spend , and a great many things . He has never held a job in the private sector , and has never had to deal with the headaches that government regulations can create , and the expenses that they cause . He is hardly one to champion the cause of “the little guy .”

President Barack Obama says his next Fed chairman should take ordinary people into account when setting monetary policy.

Obama told The New York Times in an interview on the paper’s website Saturday that he wants someone who won’t just work abstractly to keep inflation in check and maintain stability in the markets. He said he wants the next Fed chairman to also promote policies that will help make ordinary people’s lives better.

The president began a series of speeches last week promoting ideas for easing the burdens on the middle class.

Obama is considering replacements for Ben Bernanke, whose term as Fed chairman expires early next year.

Former Obama economic adviser Larry Summers and Janet Yellen, the Fed’s current vice chair, are among the leading candidates for the job.

A senior White House official told The Associated Press on Friday that Obama was not expected to announce a replacement for Bernanke before the fall. The official was not authorized to speak by name about internal White House deliberations over personnel decisions.

.. A reporter is doing her or his job . Even though , normally , possession of certain material is a very big no – no (ie , illegal) . A reporter , especially one doing their job , is given a certain amount of latitude . It appears that the ObamaCrap Department of InJustice has really done it again .

.. James Rosen is a solid reporter . He is a long – time correspondent for FoxNewsChannel , covering State , Defence , and Intelligence issues . He is not someone who is known for stepping over a line . He has , to my knowledge , a very understated manner , but a very strong professional reputation . How anyone can think of him as the target of any kind of criminal investigation , I do not understand .

.. Well , guess what . Jimmy Rosen , it appears , is on the hot seat . Until now , in secret . The InJustice Department was conducting a criminal investigation , one that you would think would target someone in their own department . Well , no  . They are  going after the media . Again .

.. You think , after the AP imbroglio , they would have learned their lesson . Unfortunately , that appears not to be the case . InJustice is targeting Rosen , but not just him . They are going after another FoxSnooze producer , along with west – coast based correspondent William LaJeunesse . Why ?

When the Justice Department began investigating possible leaks of classified information about North Korea in 2009, investigators did more than obtain telephone records of a working journalist suspected of receiving the secret material.

They used security badge access records to track the reporter’s comings and goings from the State Department, according to a newly obtained court affidavit. They traced the timing of his calls with a State Department security adviser suspected of sharing the classified report. They obtained a search warrant for the reporter’s personal e – mails.

The case of Stephen Jin-Woo Kim, the government adviser, and James Rosen, the chief Washington correspondent for Fox News, bears striking similarities to a sweeping leaks investigation disclosed last week in which federal investigators obtained records over two months of more than 20 telephone lines assigned to the Associated Press.

Obama last week defended the Justice Department’s handling of the investigation involving the AP, which is focused on who leaked information to the news organization about a foiled plot involving the al-Qaeda affiliate in Yemen. AP executives and First Amendment watchdogs have criticized the Justice Department in part for the broad scope of the phone records it secretly subpoenaed from AP offices in Washington, Hartford , Conn., and New York.

“The latest events show an expansion of this law enforcement technique,” said attorney Abbe Lowell, who is defending Kim on federal charges filed in 2010 that he disclosed national defense information. A trial is possible as soon as 2014. “Individual reporters or small time periods have turned into 20 [telephone] lines and months of records with no obvious attempt to be targeted or narrow.”

The president said press freedoms must be balanced against the protection of U.S. personnel overseas. According to the office of Ronald Machen Jr., the U.S. attorney for the District, its prosecutors followed federal regulations by first seeking the information through other means before subpoenaing media phone records. Machen’s office is investigating both the Kim and AP cases. The Justice Department said in a statement that in both cases it had abided by “all applicable laws, regulations, and longstanding Department of Justice policies intended to safeguard the First Amendment interests of the press in reporting the news and the public in receiving it.”

.. I should not be really surprised at Media Matters . As one of the various media organs of the ObamaCraps , they seem to suck up to them , like almost no one . But , yesterday ‘ s production is beyond outrageous .

.. I can understand a national security – related investigation . When sensitive or secret information is leaked , it is wrong . It is a crime . It is most definitely a serious offense . It is something that it not to be taken lightly .

.. However , going after the media with a broad brush is beyond outrageous . It is chilling . Whether there should be a federal media shield law is open to debate . This scandal has brought it back with a roar . But the media has a job to do . A good job . What they do is not a crime .  They will co – operate with the government , when there is good enough reason .

.. Doing what the ObamaCrap Department of InJustice has done is waaay over the line . What Media Matters did , with their talking points in support of the probe , is grotesque and beyond the pale .

The shift is a coup for immigration reform advocates who argue that the term is unfair.   The argument against the term “illegal immigrants” is that human beings are not themselves illegal, their actions are. The AP calls for detail: “Specify wherever possible how someone entered the country illegally and from where. Crossed the border? Overstayed a visa? What nationality?” Jonathan Rosa, a linguistic anthropologist at the University of Massachusetts, told NPR recently that he opts for the more concise ”unauthorized migrant.”

organizations to drop the term “illegal immigrant.” President Obama and immigration

reform advocates in the Senate have preferred the term “undocumented,” while opponents

of reform often emphasize the term “illegal.”   “The Associated Press got this right, no human being is illegal,” Vargas said Tuesday.

“Now it’s time for other news outlets to follow the AP’s lead and end it for good.”   So if they’re not illegal or undocumented, how should one refer to the 11 million

people in the country illegally? The AP calls for detail: “Specify wherever possible

how someone entered the country illegally and from where. Crossed the border?

Overstayed a visa? What nationality?” Jonathan Rosa, a linguistic anthropologist at the

University of Massachusetts, told NPR recently that he opts for the more concise

”unauthorized migrant.”
