… The Issue is ” Disparate Impact ” [#legal theory]…

Posted by paulfromwloh on Saturday,December 5th,2015

.. my home state of Ohio is involved in one honey of a brawl over the management of early voting . It is a doozy . Now the US Supreme Court has gotten involved . They had no choice , to be honest …

.. The political leadership thought that there needed to be ” reform of the reform . ” Early voting is nice , to be sure . But it is too much of a good thing . The Ohio Legislature acted to bring some rhyme and reason , along with some restraint to the process . They pulled back the reins on the Early Voting process , and granted the county boards of election [who , along with the Secretary of State , manage the process in Ohio] more ability to manage their financial and personnel resources …

.. The radical left had a massive hissy fit . So , as usual , they decided to bring a lawsuit . They wanted to find a ” friendly judge . ” Unfortunately , downstate , in the central and southern districts of the state , they found one .  The radical activists sought out a friendly judge in order to get a favourable ruling in their lawsuit . They brought the lawsuit in order to bring back elements of early voting that the state of Ohio does not deseire to have remain in effect …

.. These are things that the State has found are totally unnecessary .One is ” Golden Week , ” where people may register and then vote at the same time . That is outrageous . A county board of elections in my state deserves the right to check databases in order to verify the legitimacy of the registration . Another is evening voting , along with Sunday voting . The BOEs have a right to manage their resources , according to the will of the vovters and the legislature of the State of Ohio . It is not the province of a radical activist judge , whether it be a district court judge , or a group of appeals court judges , to impose their judgement , where their idea of the law has been total rejected by the vast majority of the courts …

.. Theier problem is over what is known in legal circles as ” disparate impact ” legal theory . Generally , you need to have direct impact of evidence of discrimination to interfere with their management of their affairs . What disparate impact does is sinister . It infers discrimination based upon the numerical impact on various ” protected classes , ” such as minorities . Once that happens , then the burden of proof flips to the other party to prove legitimacy , which , usually is next to impossible …

.. The impact of ” disparate impact ” usually ends up leading to greatly enhanced affirmative action . Not just affirmative outreach to affected groups , mind you … It means the adoption of numerial goals , or , in effect , quotas , by class , gender , etc …

.. there you see the problem . The liberals and the radical activists still cling to this outdated and racist legal theory . It has been discredited , time after time after time . Yet , these nutjobs still act to cling to this …

… Now You Call This Incredibly Stupid [#email sharing][#Clintonoid Foundation]…

Posted by paulfromwloh on Sunday,November 15th,2015

.. sharing information with a foundation is one thing . It is part and parcel of the non – profit business . But for a government ?

.. it is a very , very different matter when it comes to a government agency . Governments should be sharing information sparingly with outsiders . It is different issue , for example , when you deal with the F.O.I.A. and F.O.I.A. requests …

.. but when it comes to classified information ?? …

.. Cheryl Mills has been in the Clinton inner circle for years . She is probably Miz Hillary ‘ s most senior and most trusted aide . However , it does not give her license to do whatever she wants , whenever she wants to do it . In particular , doing it with classified information ..

.. it appears [from the evidence] that she has been openly sharing information with the Clinton Foundation .. Why ??

… Amazing ! [#ObamaCraps][#Iran Nuclear negotiations]…

Posted by paulfromwloh on Saturday,July 11th,2015

.. these idiots are not even really negotiating with Iran . It is as if our country [the U.S.] is taking the side of Iran , and we are negotiating with the P5 …

.. the ObamaCraps are excusing almost everything that the Mullahs do and lie about . They seem to want a deal that bad ..

.. [h/t — HotAir.com]…
.. [link] to the blog post …

..  to quote Ed Morrissey [of HotAir] …

It seems as if the Obama Administration has “switched sides,” playing the role of Iran’s attorney and explaining away their violations, rather than protecting the country by guaranteeing that Iran follow the JPOA.  As the AP article about the IAEA report reminds readers, it is in the administration’s best interests to ignore or spin away any violations.

“Violations by Iran would complicate the Obama administration’s battle to persuade congressional opponents and other skeptics.”

Even more serious than the administration saying the Iranians cheated but it doesn’t count, is that they are also saying that Iran complied with the JPOA— a legal statement – even though Iran didn’t. It’s the administration that invented the compliance.

When the administration officials go to the Hill to explain the “science” behind the one-year breakout timeline (which they insist they can achieve, despite giving into Iran’s demand to spin thousands of centrifuges because Iran will convert any overages into yellowcake) they will be misstating the truth (lying). The evidence suggests that the Iranians can’t or won’t implement those requirements.

Some may say reports of Iranian violations are just a “neocon” effort to question the administration’s policy of sitting down with Iran, or that they should agree to separating the issues of Iranian state sponsorship of terrorism and holding of American prisoners from the talks. Nonsense. Even those who support the talks must realize that what we are seeing here is that the president is so desperate for a deal that he will wish away Iranian malfeasance and risk a nuclear conflagration that has the potential to kill millions here in the United States and throughout the world .

… This is Damned Suspicious [#Argentine Prosecutor Death]…

Posted by paulfromwloh on Sunday,June 14th,2015

.. do you really believe that this guy committed suicide . No , I did not think so …

.. this guy was evidently a law – and – order hardcase . Because of that , he and his investigative team posed a real threat to the government of Christina Kirschner > So , conveniently , he OFFed himself ?!?! yeah , right …

.. [h/t — TWS.com]..

.. hopefully , there are more Argentines like him . if the Kirschner Government is in fact really guilty of corruption , abuse of power , or other offenses , then those allegations deserve to get a thorough airing . Most of all , they sure as hell do not deserve to be covered up , as it tends to happen in Argentina …

.. hopefuuly , soon , the people of Argentina are going to have a serious day of reckoning with the Kirschners and their cronies . Then , Argentina can truly get a government worthy of the possibilities of this grand country . Instead , it tens to get stuck with a corrupt kleptocracy , with often fails them …

… Brian Williams is in Serious Trouble [#FibGate]…

Posted by paulfromwloh on Wednesday,February 11th,2015

.. and his career is at stake …

.. whether NBC News will do anything about is really open to question . Ever since Washington Bureau Chief Tim Russert died in 2008 , it seems that NBC news as a whole has been an aimless and colossal mess . Scandaer scandal . A distinct lack of professionalism . A cable channel [pMSNBC] that has run wild with ultra liberalism to plain old out and out communism …

.. Should Williams resign ?!?! Maybe . Should he be fired ?!?! He should be , but likely will not be . I think that he should quit ….

… How Low can It Go ?!?! [#NYPD relations with de Blasio]

Posted by paulfromwloh on Wednesday,December 31st,2014

.. I guess that it is really gone down about as far as it can go …

.. this is video of Mayor de Blasio entering a local NYC hospital to console and comfort a family of one of the slain NYPD officers …

.. the regular street cops that were there saw him coming . de Blasio is nearly 6’6 1/2″ tall , so he is very hard to miss when he enters a public venue . Well , the guys and gals caught him coming , and ….

.. I very highly doubt that the relationship between de Blasio and the regular street cop can be salvaged . ” Big Bird ” campaigned for office on their backs , and they know it . He has acted to try to disarm them of effective tactics that they can use for their enforcement of the law on the job . Yet Big Bird does not like it , because it offends his effeminate sensibilities . That is why the regular street cop does not like the guy , and they have good reason to hate his guts …

… Tammy Duckworth was Screwed [#pregnancy]…

Posted by paulfromwloh on Wednesday,November 26th,2014

.. literally ..

.. Representative Duckworth is pregnant . Normally that is no big whoopee . she is an ultraliberal DemoCrap . Her politics are about as liberal as mine are conservative …

.. but , she is a war heroine …

.. she has served our country honorably , and lost parts of 2 legs in her combat service . She fought bravely , and with combat decorations . She worked her butt off to get back into politics . It took time , but she did do it …

.. Congresswoman Duckworth is unable to travel for the remaining months of her pregnancy . As a result , she is pinned back home in the Chicagoland suburban area where her district is located . She cannot right now travel to Fantasyland on the Potomac …

.. so , it should be within caucus rules [or , to make an exception] to allow Duckworth to vote by proxy in caucus leadership elections and other affairs . Except the House DemoCrap leadership is not allowing her to do so …

… Bombshell ! update [#Fast and Furious]…

Posted by paulfromwloh on Thursday,August 14th,2014

.. well , someone finally called out the ObamaCraps ..

.. unfortunately , it was not Congress .

.. the Congressional subpoena is still pending . After that , AG Holder was cited for contempt for a second time . Also , the House brought suit in the US District Court to enforce the committee subpoena . At least as of now , there has been no news notice of the court filing …

.. [h/t — TruthRevolt.org]..
.. [link] to the judicial news …

.. Judge Bates [by the way , a Bush 43 appointee] has ruled that the Holder Department of Injustice and the ObamaCrap Administration has to produce what is known as a ” Vaughn Index . ” A Vaughn Index shows the identity and short form of the content of documents that are being withheld under a claim of privilege . With the court order , especially with the F.O.I.A. case , the Judge has determined , within limits , that the privilege claim is tetantively a ” crock of [bleep] . ” So , the ObamaCraps have a serious problem …

.. usually a Vaughn Index is dealt with under ” seal . ” So , it will still be a while before we know anything about what the ObamaCrap Administration is playing ” fast and cute ” about . I wonder what is so ” white hot ” that they felt that they had to withhold it …

.. if Judge Bates allows either the index or the docs out into the public domain , this could get real interesting , folks . Fast ! …

… Netanyahu ‘ s First Duty [#Israel]…

Posted by paulfromwloh on Thursday,August 7th,2014

.. is to Israel , first , foremost , and always ..

.. no matter how much bullying and intimidation comes from the ObamaCraps , the United States will always be an ally of Israel . Right Now , His Lordship is an outlier . He is as anti – Israel an American president as there has ever been . Virtually any other Democrat worth a damn is willing to stand foursquare fully by Israel . They do not have to like everything an Israeli PM does . Most US Presidents do not , from time to time …

.. But Obama is risking Democrat ties to Israel and the Jewish vote with his acts towards Israel . Israel is actually acquiring some old allies , like Egypt . Egypt will never be a warm ally of Israel . But , the Egyptians will have many common interests with Israel , and will act accordingly . They want Hamas gone as much as Israel does . They are not the only ones ..

.. the Gulf states (virtually all of them , including Kuwait and Saudi Arabia) , in particular , the Saudis , are becoming more warm towards Israel . Like Egypt , they will never be buddy – buddy . However , they will have many common strategic interests with Israel , and will be willing [under the table , of course] , to act on them . So , Israel ‘ s strategic situation is not as dire as many people might think …

.. Turkey is a problem child . Recep Erdogan does have a lot of power . The problem is , that Turkey is a secular Muslim country . Nothing that Erdogan does or tries will change that . They are no longer buddy – buddy with Israel , but Erdogan is not stupid . The U.S. would side with Israel in a head – butting over Turkey , like it or not …

.. I wonder how arrogant and damn narcissistic Barack Obama really is . He is really playing with fire with the situation with Israel . Putting Israel at grave risk could cause a great re – evaluation in the Jewish vote , and that would accelerate a great upcoming change in Judaism .

..It is becoming steadily younger , and much more conservative . It will not p=ut New York in play , or Chicago , However , it would put Delaware in pink state territory , along with New Jersey . It would make Conneticut light blue , as worst , and make Illinois and Minnesota toss – up states ….

.. Bibi ‘ s first duty is to his own nation . Its own security , and its own future . It means standing up to an ally , especially when the nation backs you , but the POTUS is a god – damn jackass …

.. POTUS has to be careful , too . If he places Israel in grave danger , and gets caught in the act , Democrats could easily find it a much easier time to vote for impeachment or for POTUS ‘ conviction at trial in the Senate …

… A Sad Tale [#the hunt for pvt bergdahl]…

Posted by paulfromwloh on Saturday,June 14th,2014

.. this is a link to a favorite media site of mine , Newsbusters …

.. it carries the original story of how Bergdahl ‘ s fellow trooper ‘ s lives and duties were disrupted when he went AWOL … Also , there were at least 8 troopers that died , not 6 as the media has been reporting …

.. [h/t — m.Newsbusters.org]
.. [link] to the column ..

.. the summation of the column is this … this is the most pertinent part ….

.. from Michelle Malkin ‘ s column (the last 2 paragraphs) …

My source did not mince words: “The fact that our government negotiated with terrorists and our enemy is incomprehensible. The fact that they exchanged five war criminals for a traitor is sickening. The worst part for those of us that suffered through that time is that PFC Bergdahl is being hailed as some kind of hero. He was automatically promoted to Specialist and Sergeant, ranks he does not deserve and did not earn. I have no doubt he will receive back pay for these past five years, a substantial sum. There will be book deals, and his family are celebrities. I am glad he is safe, and happy for his family, but he should return home to face a court martial.”

Are you listening, Capitol Hill and America? The Bowe Bergdahl mess isn’t just a story about one deserter, but two. There’s the muddle-headed lowlife who left his post and brothers behind. And there’s the corrupt commander in chief who has jeopardized more American soldiers’ lives to “rescue” Bergdahl by bowing to the Taliban, while snubbing the surviving heroes and the eight dead American soldiers who lost their lives because of him. This cannot stand.

… It Really gets Infuriating [the ” Plame ” Leak] …

Posted by paulfromwloh on Friday,June 6th,2014

.. especially the way that people in George W. Bush ‘ s White House were tarred and feathered by the media …. even now ..

.. may God Bless Robert Novak . He was one of the best columnists that I ever have followed (ever since high school) . Unfortunately , he was taken from us much too soon , due to a brain tumor in 2009 . Novak should know . He was the columnist who originally reported the leak . He knew who was his source . He was the best , and he protected his source . You know that he would …

.. [h/t — m.Newsbusters.org]..

.. [link] to the column ..

.. just so you know about the accurate reporting of the resolution of the leak investigation , at least where it regarded Novak , I am going to reprint in full his 2006 column outing the leaker . The leaker [Armitage] had already been outed , courtesy of a book written several months before by Michael ” Spikey ” Isikoff and David ” Lunatic ” Corn  …

When Richard Armitage finally acknowledged last week that he was my source three years ago in revealing Valerie Plame Wilson as a CIA employee, the former deputy secretary of state’s interviews obscured what he really did. I want to set the record straight based on firsthand knowledge.

First, Armitage did not, as he now indicates, merely pass on something he had heard and that he “thought” might be so. Rather, he identified to me the CIA division where Mrs. Wilson worked and said flatly that she recommended the mission to Niger by her husband, former ambassador Joseph Wilson. Second, Armitage did not slip me this information as idle chitchat, as he now suggests. He made clear that he considered it especially suited for my column.

An accurate depiction of what Armitage actually said deepens the irony of his being my source. He was a foremost internal skeptic of the administration’s war policy, and I had long opposed military intervention in Iraq. Zealous foes of George W. Bush transformed me, improbably, into the president’s lapdog. But they cannot fit Armitage into the left-wing fantasy of a well-crafted White House conspiracy to destroy Joe and Valerie Wilson. The news that he, and not Karl Rove, was the leaker was devastating for the left.

A peculiar convergence had joined Armitage and me on the same historic path. During his quarter of a century in Washington, I had had no contact with Armitage before our fateful interview. I tried to see him in the first 2 1/2 years of the Bush administration, but he rebuffed me — summarily and with disdain, I thought.

Then, without explanation, in June 2003, Armitage’s office said the deputy secretary would see me. This was two weeks before Joe Wilson outed himself as author of a 2002 report for the CIA debunking Iraqi interest in buying uranium in Africa.

I sat down with Armitage in his State Department office the afternoon of July 8 with tacit rather than explicit ground rules: deep background with nothing said attributed to Armitage or even to an anonymous State Department official. Consequently, I refused to identify Armitage as my leaker until his admission was forced by “Hubris,” a new book by reporters Michael Isikoff and David Corn that absolutely identified him.

Late in my hour-long interview with Armitage, I asked why the CIA had sent Wilson — who lacked intelligence experience, nuclear policy expertise or recent contact with Niger — on the African mission. He told The Post last week that his answer was: “I don’t know, but I think his wife worked out there.”

Neither of us took notes, and nobody else was present. But I recalled our conversation that week in writing a column, while Armitage reconstructed it months later for federal prosecutors. He had told me unequivocally that Mrs. Wilson worked in the CIA’s Counterproliferation Division and that she had suggested her husband’s mission. As for his current implication that he never expected this to be published, he noted that the story of Mrs. Wilson’s role fit the style of the old Evans-Novak column — implying to me that it continued reporting Washington inside information.

Valerie Plame Wilson’s name appeared in my column July 14, 2003, but it was not until Oct. 1 that I was contacted about it by Armitage, indirectly. Washington lobbyist Kenneth Duberstein, Armitage’s close friend and political adviser, called me to say that the deputy secretary feared he had “inadvertently” (the word Armitage used in last week’s interviews) disclosed Mrs. Wilson’s identity to me in July and was considering resignation. (Duberstein’s phone call was disclosed in the Isikoff-Corn book, which used Duberstein as a source. They reported that Duberstein was responsible for arranging my unexpected interview with Armitage.)

Duberstein told me Armitage wanted to know whether he was my source. I did not reply because I was sure that Armitage knew he was the source. I believed he contacted me Oct. 1 because of news the weekend of Sept. 27-28 that the Justice Department was investigating the leak. I cannot credit Armitage’s current claim that he realized he was the source only when my Oct. 1 column revealed that the official who gave me the information was “no partisan gunslinger.”

Armitage’s silence for the next 2 1/2 years caused intense pain for his colleagues in government and enabled partisan Democrats in Congress to falsely accuse Rove of being my primary source. When Armitage now says he was mute because of special prosecutor Patrick Fitzgerald’s request, that does not explain his silent three months between his claimed first realization that he was the source and Fitzgerald’s appointment on Dec. 30, 2003. Armitage’s tardy self-disclosure is tainted because it is deceptive.

… LEC again …

.. I still wonder why : why Dubya did not pardon Scooter Libby , and why he did not fire Patrick Fitzgerald …. as to Libby , he was grossly mistargeted . He had no business being picked on the way that he was by the special prosecutor . Once Fitzgerald knew who the leaker was [Richard Armitage , Colin Powell ‘ s deputy at the time] , that was it . The investigation was over

… As to Fitzgerald , he grossly abused his power . He carried on with the investigation for far longer a period of time and for far broader a latitude of scope than should have been allowed . It was not the absolutely gross abuse of power that Lawrence Walsh pulled in his father ‘ s time , but it was damn close . Dubya should have shut Fitz down , effectively , by pardoning Libby , Rove , and the other parties in the probe . That would shut Fitz down without having to fire him , which I think he should have done anyway …

… Astonishing — Roast POTUS on a Spit [VAgate]…

Posted by paulfromwloh on Saturday,May 31st,2014

.. Obama has to be kidding ?!?! ..

.. he actually defended Eric Shinseki at a White House Press Conference ? ..

.. what he should have done is fired the bastard . He needs to go , and he is not the only one . The Department of Veterans Affairs needs a thorough reorganization and housecleaning . Like yesterday …

.. [h/t — hotair]..
.. [link] to the USHouse floor speech …

.. David Scott is no shrinking violet , nor a conservative . The fact that he took to the House floor to tear the cover off of both POTUS and SecVetsAff is really something . Scott is a member in good standing of the Congressional Black Caucus , and I would think that he would have let his C.B.C. colleagues , at the very least , know about what was coming …

… Cleveland V.A. Medical Center — An Update …

Posted by paulfromwloh on Saturday,May 31st,2014

.. hey folks , it is my neck of the woods …

.. I will keep you up to date on them . I do expect them to join the parade any day now . Trust me , the local media is in hot pursuit on this . You can bet that the local population is paying attention …

.. F.Y.I. — at least , the Cleveland Stokes V.A. Medical Center does have some excuses . Not many . Greater Cleveland used to have 2 VA medical centers , one in the south suburbs [Brecksville , 1/2 way to Akron] , and the Stokes VA Med Center . Stokes VA is in University Circle , north of Case Western Reserve University , and all of the other features of Cleveland ‘ s University Circle area [including Severance Hall , home of the Cleveland Orchestra] …

.. two years ago , the two medical centers were formally merged into one . Some parts of the Brecksville facility remain open as a medical clinic , but the in – patient section of the facility is now closed . Stokes VA has been expanded to accommodate the workload ….

.. so , you see that I expect them to join the parade . It is not when they do it , it is how , and which local TV station fillets their fanny . Trust me , they are not going to like it one bit …

… Those Dummies Knew [VAgate] …

Posted by paulfromwloh on Thursday,May 29th,2014

.. what a big surprise ! ..

.. still , it is damning ..

.. [h/t — WashingtonTimes]..

.. [link] to the article ..

.. did it originate in the Bush Admin ? Yes . However , it started late in their time , and it was not in an easy position for them to deal with it . The big problem for them would have been the DemoCraps and their socialist Demagoguery in Congress . So , they did pass the ball , and gave the ObamaCraps a head’s up …

.. the Washington Times found evidence the Obama administration knew about the problems from the time of its transition into the White House :

The Obama administration received clear notice more than five years ago that VA medical facilities were reporting inaccurate waiting times and experiencing scheduling failures that threatened to deny veterans timely health care — problems that have turned into a growing scandal.

Veterans Affairs officials warned the Obama-Biden transition team in the weeks after the 2008 presidential election that the department shouldn’t trust the wait times that its facilities were reporting.

The briefing materials, obtained by The Washington Times through the Freedom of Information Act, make clear that the problems existed well before Mr. Obama took office, dating back at least to the Bush administration. But the materials raise questions about what actions the department took since 2009 to remedy the problems.

.. for the ObamaCraps , they wanted to do the traditional liberal remedy : they threw money at the problem. They have little incentive to do much of anything else …

.. to remedy the problems though would have made them public , and think back then to early 2009 : Team Obama was trying to sell America on Obamacare, so it’s extremely unlikely that people calling for a greatly increased government role in health care would want to make public a horrific example of what can happen when bureaucrats are in charge of a health care operation. The Obama administration — or any Dems pushing for Obamacare or single-payer — wouldn’t have wanted to shine a light on the VA debacle for the same reason airlines don’t show “Mayday at 40,000 Feet” as the in-flight movie .

.. so , they kept their mouths shut . Now , the bug is coming back to bite them … Big Time  !! …

There does appear to be a time span that will allow Team Obama to blame Bush, and don’t think they won’t run with that. However, that does little to explain why nothing was done about the problem for years since.
