… Nice Going , Sheriff Joe …

.. for those who do not know , Joe Arpaio ranks right up there as America ‘ s toughest sheriff . And he needs to be .

.. My native state , Ohio , is about the same size as his , Arizona . Ohio has 88 counties . Arizona has only 15 of them . My home county (Cuyahoga) is only about 1,250 square miles , of which 2/3rds is frozen at the surface [water] as it is Lake Erie .

.. Arizona ‘ s counties are far larger . Ohio does border Canada , but we are fortunate . Canada is a relatively peaceable border . Arizona borders Mexico , which to say the least , is not a peaceable border , in any instance . Maricopa County , which is where Phoenix (the state capital) is located , is nearly 9,750 square miles , all land , virtually no water .

.. So , Sheriff Joe has to be a hard case . He has quite a bit bigger spit of land to patrol , and he also has to deal with the spillover from the illegal immigrants who make up the large mass of the border traffic . Texas has the Rio Grande river for its entire border length . California ‘ s southern border has been largely tacted in by fence , and the illegal traffic still makes its way in . New Mexico ‘ s border is heavily mountainous , making crossing [egress] the border there far more dangerous . So , Arizona has a big target on its back .

.. Each jail cell has an American flag in it . The inmates do not like it all that much , to say the least . They have taken to pissing off the county sheriff ‘ s deputies by desecrating the flag in various ways . So , Sheriff Joe is cracking down , and doing it hard … by putting the violators on bread and water .

.. Nice . Putting them on bread on water is to say the least more than a little old fashioned . However , it is still legal as well as moral . I would advise Sheriff Joe to put the whole jail on it until the offenders stop . It would send a harsh message through the cons to knock it off …. or else . Jailhouse justice is harsh , but it is effective . The cons will get the message , and send the word around to the idiots to stop it ..

The House Republicans released a video Monday in anticipation of Obama’s State of the Union speech, tomorrow. The video takes us on a trip down memory lane to the president’s last five SOTU addresses, foreshadowing his next round of empty promises and disingenuous happy talk.

In this video, House Republicans look back at Obama’s sickening  lies on ObamaCare:

Last week, Mark Levinsuggested that the GOP boycott the SOTU. I think every sentient being in the country should. (I realize that excludes most Democrats.) Let Obama speak to his own dwindling, tone deaf, cacophonous  choir.

They need to do something bold that will get the attention of some of our fellow citizens and which the media, which will attack it, but cannot ignore it.

If they’re not going to take a stand constitutionally and legally, they should at least take a stand on the steps of the Capitol or somewhere. Together, shoulder…

There are five specific questions dealing with the IRS, NSA and Benghazi scandals, ObamaCare, and jobs, that Senator Ted Cruz would like the president to answer in his State of the Union speech, Tuesday.
Today the Texas Senator talked to Gretchen Carlson of Fox about questions he (and many Americans would like answers to).
On Obamacare, he reiterated his assertion that Obama should apologize for lying about ObamaCare, saying “over 5 million people trusted President Obama when he said ‘if you like your health insurance plan you can keep it; if you like your doctor, you can keep your doctor.’ We now know that statement wasn’t true, and if he was actually taking responsibility for his action, he would number one say I am sorry, but then number two, he would act to fix it. .. She seems to think that the stay that the U.S. Supreme Court issued in the case of the Little Sisters of the Poor v. Sebelius is only a matter of paperwork . She could not be more wrong …

.. It is a significant legal victory . Even though it does not say anything on the merits of the case , the grant of a stay says volumes about the possibility of the case being won . One is that to get a stay is that you have to have the strong possibility of winning on the merits . The second is that you have to have the likelihood of suffering a significant ” harm . ” That ” harm ” does not always have to be financial , but it often is . The Supremes would not likely have granted a stay otherwise in the case .

.. The idea of ObamaCrapCare is to cover the uninsured . What it has been doing , however , has been to totally screw up the regular insurance markets . It has also called into question how many people are actually uninsured , and how those numbers are being measured . Where that hits is that if these folks are not enrolling , is why ? The law ‘ s official name is the Affordable Care Act . if the insurance is in fact unaffordable …

Aetna CEO: We might have to pull out of ObamaCare because it’s not attracting uninsured

One of the nation’s biggest health insurers is worried enough about a scenario in which it would have to pull out of Obamacare exchanges that its CEO is willing to talk about the possibility on national TV from Davos. It may be partly a signal to the administration to get this train moving, but it’s no doubt also a reckoning with reality. Obamacare is not attracting the uninsured, and if the administration would stop changing the rules long enough for insurers to get a handle on who is in the exchange population, they’d no doubt find that population is far more sick and expensive than it was supposed to be.

Aetna CEO Mark Bertolini told CNBC on Wednesday that Obamacare has failed to attract the uninsured, and he offered a scenario in which the insurance company could be forced to pull out of program.

The company will be submitting Obamacare rates for 2015 on May 15.

“Are they going to be double-digit [increases] or are we going to get beat up because they’re double-digit or are we just going to have to pull out of the program?” Bertolini asked in a “Squawk Box” interview from the World Economic Forum in Davos, Switzerland. “Those questions can’t be answered until we see the population we have today. And we really don’t have a good view on that.”

He said that so far, Obamacare has just shifted people who were insured in the individual market to the public exchanges where they could get a better deal on a subsidy for coverage. “We see only 11 percent of the population is actually people that were firmly uninsured that are now insured. So [it] didn’t really eat into the uninsured population.”

For Obamacare to work better, it needs more flexibility and choice of insurance programs, Bertolini said. “We need to make it a lot more simpler for people. There needs to be more choice. When you get more choice, you make it more of a market and you get more people in the program.”

Bertolini’s comments illustrate the bind the insurance industry is in—and, yes, they jumped in with Obama on this deal expecting a bunch of people to be forced to buy their product. Obamacare has failed in such a way as to force them to raise rates dramatically. If they raise rates dramatically, the very administration that needs them to stick with the program will be calling them bad apple patent medicine salesmen because vilifying them will be the only hope for politically extricating itself from its policy failure, at least temporarily. And, in the meantime, the industry can’t even get a handle on who is in the exchanges because the administration keeps changing the rules every five minutes. A couple of industry folks told me last week, even if the news about the make-up of the exchanges is bad, it’d be better to figure it out, get some experience with the population, and gauge what can be done for cost containment. Obama’s short-sighted game of switcheroo doesn’t allow much actuarial science to take place.

.. he is apparently being advised by Iranian operatives , which would explain a fair bit of his antics the last few years . Karzai has been no end of a pain in the butt for Obama and his people the whole time that he has been in office . Nice for them , but not for him .

.. A U.S. force would be a stabilizing element in Afghanistan . Especially considering who borders the country , and who is trying to influence its internal politics . However , POTUS may completely withdraw U.S. forces from the nation by the end of 2014 if Karzai does not quit screwing around .

.. If he continues to do so , he could end up getting his neck stretched by the Taliban . Given the corruption of the Karzai years , he probably has a sky – high price on his head . Any Talibani sympathizer would be handsomely rewarded for taking him out , whether the U.S. remains or not .

The first Supreme Court stay of the HHS contraception mandate, issued by Justice Sonia Sotomayor on New Years Eve, was a pause in the proceedings in order for the court to consider whether the Little Sisters of the Poor would suffer significant damage if forced to comply while their challenge is on appeal. Today, the whole court issued a stay of more significance — one that extends to another group suing to block enforcement:

The Supreme Court said on Friday that, while litigation continues, the federal government may not enforce a part of President Barack Obama’s healthcare law that requires employers to provide insurance covering contraception against an order of nuns and one other Roman Catholic Church-affiliated group.

The court said, however, that the groups in question must first notify the Department of Health and Human Services in writing that they object to the so-called contraception mandate.

The Washington Post has the full order, which is brief enough. Note the caveat:

The Court issues this order based on all of the circumstances of the case, and this order should not be construed as an expression of the Court’s views on the merits.

However, in order for a court to issue a stay, there generally has to be two measures met. First, the applicant has to have a real chance at winning the argument, and there has to be demonstrable and significant damage resulting from a denial of a stay. If the court agrees that the Little Sisters and the Christian Brothers (the other plaintiff) both have a real chance of prevailing on the merits and will suffer damage without injunctive relief, then it seems that the Supreme Court is at least open to their case.

Gabriel Malor, as usual, warns to keep things in perspective:

 

The accommodation is what is supposed to allow the mandate to pass muster in regard to religious freedom, though. If that fails, the mandate will have a difficult time standing, too. And keep in mind that for technical reasons related to the insurance used by the Little Sisters, theirs isn’t the strongest legal challenge eventually coming to the Supreme Court.

Update: Ed Whelan notes that this order was apparently unanimous:

Without recorded dissent, the Supreme Court has enjoined the federal government from enforcing the HHS mandate against the Little Sisters of the Poor and their co-plaintiffs during the pendency of their Tenth Circuit appeal. More precisely, injunctive relief is available to each plaintiff if it informs HHS in writing that it is a nonprofit organization that holds itself out as religious and that it has religious objections to providing coverage for contraceptive services. …

It would seem that all nine justices are now part of that Catholic conspiracy that was the target of Jamie Stiehm’s idiotic anti-Catholic rant.

A lot of thought went into it, and perhaps (although not necessarily) debate, too. Interesting. Meanwhile, the Becket Fund is pretty happy with the result. Here’s their whole statement:

Washington, D.C. –  Today the Little Sisters of the Poor received an injunction from the Supreme Court protecting them from the controversial HHS mandate while their case is before the Tenth Circuit Court of Appeals.  The injunction means that the Little Sisters will not be forced to sign and deliver the controversial government forms authorizing and instructing their benefits administrator to provide contraceptives, sterilization, and drugs and devices that may cause early abortions (see video). The Court’s order also provides protection to more than 400 other Catholic organizations that receive health benefits through the same Catholic benefits provider, Christian Brothers.

“We are delighted that the Supreme Court has issued this order protecting the Little Sisters,” said Mark Rienzi, Senior Counsel for the Becket Fund. “The government has lots of ways to deliver contraceptives to people–it doesn’t need to force nuns to participate.”

To receive protection, the Supreme Court said that the Little Sisters and other organizations that receive benefits through Christian Brothers must simply inform HHS of their religious identity and objections. The Court said that the Little Sisters did not have to sign or deliver the controversial government forms that authorize and direct their benefits administrator to provide the objectionable drugs and devices.

The order was issued by the entire Supreme Court. Justice Sonia Sotomayor, who is the Justice assigned for emergency applications from the Tenth Circuit Court of Appeals, had previously issued a temporary injunction to allow the court time to consider the Little Sisters’ emergency appeal, filed on New Years’ Eve.

Prior to the order, injunctions had been awarded in 18 of the 19 similar cases in which relief had been requested.

“Virtually every other party who asked for protection from the mandate has been given it,” said Rienzi.  “It made no sense for the Little Sisters to be singled out for fines and punishment before they could even finish their suit.”

The Little Sisters are joined in the lawsuit by religious health benefit providers, Christian Brothers Services, Christian Brothers Employee Benefits Trust.  The lawsuit is a class action on behalf of all the non-exempt organizations that receive benefits through Christian Brothers. The Plaintiffs are also represented by Locke Lord, a national law firm, and by Kevin Walsh, a law professor at the University of Richmond.

To date, there are currently 91 lawsuits challenging the unconstitutional HHS mandate. The Becket Fund represents: Hobby Lobby, Little Sisters of the Poor, GuideStone, Wheaton College, East Texas Baptist University, Houston Baptist University, Colorado Christian University, the Eternal Word Television Network, Ave Maria University, and Belmont Abbey College.

The Becket Fund for Religious Liberty is a non-profit, public-interest law firm dedicated to protecting the free expression of all religious traditions—from Anglicans to Zoroastrians. For 19 years its attorneys have been recognized as experts in the field of church-state law. The Becket Fund recently won a 9-0 Supreme Court victory in Hosanna-Tabor v. EEOC, which The Wall Street Journal called one of “the most important religious liberty cases in a half century.”

Update: Gabriel posts a rebuttal at AoSHQ to those who somehow considered this a defeat for the Little Sisters. UCI professor Rich Hasen argued that the requirement to object in writing to HHS to get coverage under the stay triggers the birth control coverage, but that’s nonsense:

First, the coverage the Little Sisters object to is not triggered by giving HHS notification, as contemplated by the Supreme Court order. Rather, it is triggered “[i]f a third party administrator receives a copy of the self-certification,” i.e., the accommodation form that organizations objecting to the contraception mandate have to fill out. You can check me on this, if you like (PDF). The Supreme Court order specifically says that the Little Sisters notification to HHS does not have to use the accommodation form or provide it to their third-party administrator. Thus, providing an alternative notification to HHS does not trigger the objectionable contraceptive coverage.

Also, contrary to Hasen, the insurance companies aren’t even in this. The Little Sisters use a self-insured health plan, which has a third-party administrator, again as specifically stated in the Supreme Court order, not an insured group health plan. The different types of plans have different requirements.

… The Continuing Controvery over ObamaCrapCare ..

.. the implementation of ObamaCrapCare has been a colossal failure . Even with the repairs of the website , it is not complete . The middle section [the 834 reports on enrollment] is still throwing off periodic errors , giving the insurers little confidence in enrollment numbers and reports from the government . They have had to take action themselves to reconcile things in order to get an accurate idea of who is enrolled , and who is not .

.. What is worse is the back end . It is still being built . Crist , you would figure that it would have been designed and put together before launch . Not so . Since CGI has been canned by the ObamaCraps , and Accenture has been brought in , hopefully there will be prompt and swift progress in the work . CGI was waaaay over its head . Accenture is a class outfit , top – of – the – mark in the consulting business . They should have been brought in in the first place , damn dummies !

.. it does , however , take time to do the work . Since it will take months to fix the whole operation , and finish the back end , Moody ‘ s has put the entire health care sector under negative outlook financially . to be honest , they deserve it …

Despite freezing temperatures and storm-battered travel, thousands of people marched on Washington D.C. Wednesday in the hope of protecting unborn babies from abortion. The demonstrators in the 41st annual March for Life didn’t receive the media adulation dishonest Democrat pol Wendy Davis got when she filibustered a Texas anti-abortion law last summer. But media or no media, the pro-life forces will continue the slow but relentless process of winning honest hearts and minds.

I feel sure they will, because mine is a heart they’ve already won.

Until quite recently, I was pro-abortion. I opposed Roe V. Wade — I thought it a dishonest decision that robbed the people of their right to settle the matter for themselves. But given the chance to vote on the issue, I would have voted for the greatest possible abortion access. While I myself live according to my conservative lights, I’ve never felt I have the right to impose those values on others.

I changed my mind about abortion, however, because after debating the issue with pro-lifers over many years, I found I consistently lost the argument.

I’ve changed many of my opinions as I’ve grown wiser with time, but this change was one of the hardest. Not only does it go against my libertarian nature, it also means opposing the passionately held beliefs of some of the people I love most. Several of the women in my circle feel that access to abortion is an essential right.

But why? How exactly does that argument go?

Whenever I hear abortion spokespeople defend their position — and I mean, whenever I hear them — they seem to me determined to obscure the real issue. They talk about being “pro-choice,” but who among their opponents is anti-choice? They talk about “women’s health,” but what sinister constituency demands that women be unhealthy? They talk about “protecting a woman’s body,” but it’s not the woman’s body under threat, it’s the body of the baby inside her.

During elections, our corrupt leftist journalists routinely play Gotcha with pro-life candidates by asking if they favor abortion in cases of rape and incest. But they never ask “pro-choice” candidates if they favor abortion when the mother wants a boy instead of a girl or a Sagittarius instead of a Virgo or, if it should become possible to determine, a straight son instead of a gay one. Those are all legal reasons for abortion now. Should they be? If not, why not?

Okay, aborting a baby might be liberating, empowering and convenient. It might even dramatically improve the future course of your life. But the same could be said about murdering your wife if she’s a big enough pain in the neck. That doesn’t give you the right to do it, and it doesn’t make it the right thing to do.

The only relevant question about abortion is whether an unborn child is or is not a human being. If she is, I do not see how you have the moral right to kill her except in extreme circumstances.

I know there are good people who say no, a fetus can not yet think or choose fully enough to be considered wholly human. But that viewpoint is becoming increasingly difficult to maintain as better technology reveals the complexity of life within the womb.

And even if a fetus’s humanity is not yet complete, it’s wise to consider this piece of wisdom from the Clint Eastwood western Unforgiven. When you kill a man, Clint’s character says, you “take away all he’s got and all he’s ever gonna have.” That’s right. We are creatures who exist in time. We are as much what we will be as who we are. A man who’s fast asleep can’t think or choose fully either, but he’ll be well able when morning comes. So it is with an unborn child.

My natural sympathies are with the libertarians on this issue. But logic and moral truth are with the people who marched in Washington Wednesday. And so now I’m with them too.

.. that is not stupid . What is criminally stupid is why they are being forced out . Microstamping of individual firearms is now being required in the state . In addition to being a technical pain – in – the – [bleep] , it is costly as heck .

.. It made a big splash , as you might think , in the Canadian press , but it hardly made a peep down here , other than in the conservative media . I read about it , and it evidently was a honey …

.. however , Israeli Arab lawmakers in the Knesset were extraordinarily rude to the PM . Harper made an address to the Knesset , and the Arab MKs walked out during the speech ..

While investigating Obamacare Navigators, Battleground Texas, and their connection to Obama’s Organizing for America, Project Veritascaught some “deeply offensive comments on tape.”

When I first saw the headline for this, I thought – surely not. Surely they’re exaggerating.

You tell me.

“Greg Abbott (The Attorney General of Texas) is not, he’s really not a sure thing, and he’s really not real electable. First of all he’s not good looking, he doesn’t speak very well, he doesn’t have a good personality, and he’s in a wheelchair.”

They even explore the possibility that he has a personality disorder because he “he has no sympathy for anyone or anyway.” Keep in mind these are supporters of a candidate who lashed out at the affable Abbott because of a news report he had nothing to do with. There’s plenty of fodder for a discussion on  “personality disorders” if you take a good look…

.. it harms our Constitution , our country , and our citizens .

.. when people abuse the organs of government for their own ends , and they tamper with the rights and freedoms of others .

.. Government prosecutors do have the right to set priorities to maximize the use of scarce resources . What they do not have the right to do is the refusal to enforce the body of law as a whole . Especially when and where prosecution for misconduct is called for .

.. These groups formed and applied for tax – exempt status . They thus created a IRS tax file . These files are not to be misused or abused , especially for misuse for political purposes . I am a C.P.A. , albeit on the bench . I have practiced before the service , and misuse of these files is a felony .

.. It is clear that these files have been misused . Investigation is called for , and the appointment of a Special Prosecutor or an Independent Counsel is called for ..

When Holder’s politically weaponized Justice Department filed a $5 billion dollar fraud lawsuit against S&P a year ago, who didn’t think it was political retaliation for crossing Obama?  Now, according to claims made in their multi-billion dollar lawsuit, S&P  have removed all doubt.

Via Fox News Insider:

The financial services firm, Standard & Poor’s, threw down a stunning challenge in court claiming that former U.S. Treasury Secretary Timothy Geithner threatened the chairman of S&P’s parent company in a phone call that warned of consequences after the downgrade came.

It came just days after S&P angered the White House by downgrading the U.S. credit rating in the middle of the 2011 debt ceiling debate.

Harold McGraw III said, according to the sworn legal declaration, “[Geithner] said that, ‘you have done an enormous disservice to yourselves and to your country.’”

Pro-lifers have been gathering in the National Mall in Washington every January for the past 40 years to march on the Supreme Court to mark the anniversary of Roe v. Wade.

Although participants in the pro-life demonstration  have numbered in the hundreds of thousands for years, it usually gets little or no attention in the mainstream media.

The Christian Post reported:

Even though winter storm Janus has closed down federal government offices and cancelled more than 2,000 flights in the Northeast, tens, if not hundreds of thousands of pro-life advocates are in Washington, D.C. for the 41st annual March for Life event on Wednesday.
